9/19 guaranteed ship date, seems like a clear cut case of "bait and switch" on top of the customer service failure.

The financial losses or damages acquired by a consumer due to the false or misleading advertising may not be significant. However, this is not a cost that any consumer should have to endure. Consumers who have suffered from financial losses or other damages may participate in a class action lawsuit to recover compensation for any losses incurred.

There are several types of false and misleading advertising tactics used by companies to lure in unsuspecting consumers. Some of these tactics include:

Bait & switch advertising is the advertising of a product that the business does not provide or does not intend to sell. Once the consumer is in the store, the business tries to sell the consumer a more costly item or service.
High-pressure sales tactics are used to get consumers to purchase a service or product that he or she does not want or does not intend to purchase.
Deceptive form contracts have ambiguous promises or fine print in their contracts that are usually overlooked or misunderstood.
Artificially inflating prices is used by businesses to give the illusion that a great deal on a product or service is available.
Failure to disclose is a term used for when a business does not inform consumers when an item or service is currently unavailable, or when an offer has expired.
Consumers may be awarded a variety of remedies against any business that engages in false or misleading advertising. These remedies may include:
Monetary damages
Injunctions ordering the businesses to stop running the advertisements
Injunctions ordering the businesses to stop engaging in deceptive practices
Injunctions ordering the businesses to include disclosure statements in their advertising

Good luck in proving that they purposely deceived you, me, and anyone else still waiting.  I'm would guess that they were told by Apple to expect a certain amount devices, and when that amount fell short...well guess what happens...backorders and furious consumers.  Was I upset that I had trouble pre-ordering...yes.  Was I a bit bothered when my ship date moved...you betcha!  Will my world come to an end if I don't have my new iPhone today...nope, not at all.  I'm not saying you shouldn't be bothered but it's not like it's a limited edition device and they're only producing so many.  Everyone who wants one will eventually have the opportunity to get it...some of us will just have to wait a little longer.  I'm in no way telling you not to be upset, after all, you're entitled to your own opinion and feelings...I just know that my energy could be better used on something more productive than being angry at Verizon.   After all, I know they're not sitting on a boat load of phones just pointing at laughing at the fact that I have to wait.  When they have it, they'll ship it.  I'll get mine and I'm sure if you hang in there, you'll get yours too.  Have a great evening and smile...life's much to short to spend any moment being upset over something as simple as a delayed phone.

    Yes, you will still get the prompt.
    I meant reset then try the recovery mode restore again.
    You can also try DFU Mode.
    DFU (Device Firmware Update) Mode is different than Recovery Mode.
    DFU Mode is a special mode where the device can still interface with iTunes, yet it does not load the iBoot bootloader.
    DFU Mode:
    Plug your device into your computer.
    Turn off the device.
    Hold the Power button for 3 seconds
    Hold the Home button without releasing the Power button for 10 seconds
    Release the Power Button but keep holding the Home button
    Keep holding the Home button until you are alerted by iTunes saying that it has detected a device in Recovery Mode
          NOTE: Make sure the device screen is blank and no logos are present. Be patient, it make take several trys.

  • Does anyone have any new recommendations to help iTunes recognize that my 128 iPhone and 128 iPad aren't 16 GB models?

    I have suffered from this problem for years, but since upgrading to 128 iOS devices in September, the mysterious iTunes/iOS hidden data disease has gotten intolerable. Here's the deal:
    I use my iPhone and iPad mostly for media consumption. I don't have a ton of apps. I have lots of videos, music through iTunes Match, and a few pictures. I'm one of those dinosaurs who doesn't use the cloud but downloads it, stores it, and syncs it via USB frequently (which I would bet is the root of my problem). Although I have a large capacity devices, I sync almost daily. And each time I sync, my displayed free space and the space iTunes allows me to use differs more and more. Old fixes used to involve such things as restoring the devices, turning off automatic syncing, turning off photo syncing, turning off other syncing apps, etc. And these things were temporary fixes.
    Let me give you an example of what I mean by temporary. It has been exactly eight days since I last restored my iPad to brand spanking new, retaining nothing. In those eight days and approximately eight or nine manual USB syncs, each with an average of 60 GB transferred, I mysteriously have managed to lose 40 GB. This afternoon during my most recent sync, iTunes showed 86.3 GB free. However, as usual, it wouldn't sync anything close to that. By the time I had whittled my selections down to an acceptable amount, it still showed I had 47.2 GB free both in iTunes and in Settings on the iPad. Yet when tested it by trying to sync a 50 MB app, it said there was not enough available space. In days past, problems like this would take weeks or maybe even months to accumulate. And the culprit would usually be the "Other" category. When that happened, the remedies I described would help. This new beast is something else, though. Like I said, this took only eight days.
    I finally decided to post something, though, after I reset my iPhone to factory settings this evening. When I was syncing the initial apps and videos, it would not let me sync more than 30 GB of material. I don't know what to do, guys. I bought the maximum capacity devices because I like my HD content. Does anyone know what I'm doing wrong? If you say I just need to sync less, (1), Apple needs to get its act together, and (2) It might sound crazy, but I can probably only push it to 2 days, so I'd only be postponing my problems a few days.
    If anyone can help, I would appreciate it. Forgive me if this has been addressed elsewhere. I have spent time searching, but all I found was the answers I have already tried numerous times.

    Many of us in this community are your age and older. Age has nothing to do with it, but your lack of experience with tech devices has more bearing on this than your age. However, having said that, the iPad is very easy to use. You don't need a computer at all any more in order to use an iPad.
    If you do want to use your laptop with your iPad, you must be running the latest version of iTunes and these are the specific requirements.
    Apple ID (required for some features)
    Internet access
    Syncing with iTunes on a Mac or PC requires:
    Mac: OS X v10.6.8 or later
    PC: Windows 8; Windows 7; Windows Vista; or Windows XP Home or Professional with Service Pack 3 or later

    No. If there's no backup, there is no place to get the data back from.
    Apps and music purchased from the iTunes store can be downloaded using the same ID used to purchase them at no charge. Any in app data is gone. some in app purchases may be gone.

  • I am trying to sync my iphone with itunes music and have selected 'entire music library', which shows a large amount of potential music data to be transferred.  Trouble is after sync, the bar shrinks back to just the content of one particular Playlist!?

    thank you randers4, unfortunately these restrictions aren't to blame.  Now I realise the problem - I tried to play some of the music and found out that the source data wasn't attached.  The computer was rebuilt and backed up - and it seems perhaps hasn't all been copied back.  I am currently attempting to copy accross some itunes files from my backup drive.  Bit confused, too many itunes files of different types but fingers crossed getting closer to the solution......?

When I typed in the correct security code, I discovered that there was not enough money in the card to complete the purchase anyway. Now, whenever I attempt to update my applications on my iPhone 3Gs, I am directed to the billing information from the previous purchase that did not work. How do I cancel the purchase and continue to update my applications?

    This happens for some apps. If you have a computer try to buy on it. Otherwise you will have to enter a credit card or some from of billing.
