Does an Infinity Cabinet need a further upgrade to...

Question

We upgraded to Infinity (Option 1) as soon as our cabinet was upgraded late last year.
We get a rock solid 37.44 Mb Down and around 1.7 Mb Up which I'm pleased with considering with ADSL, we were getting around 3Mb Down due to the distance to our exchange.
Our cabinet is about 200-300 metres from our house.
The question I have is, when I check our telephone number on the BT web site, it says that the maximum we can receive is 37.7 Mb.  I would have thought that given the closeness to our cabinet, we should be capable of getting closer to the 76Mb.
I guess my question is, would BT need to carry out a further upgrade to the cabinet to enable Infinity 2 speeds or is 37.7Mb all I'll be able to receive?
If I thought we could get anywhere near to the 76Mb, we would most likely upgrade.
Any help or advice anyone can provide would be appreciated.

I'm still toying with the idea of upgrading to Infinity 2, simply to remove the 40GB data cap we currently have, even if we don't see an increase in speed.
I ran a BT speed test tonight with the following results;
1. Best Effort Test: -provides background information.
    Download Speed
    36.92 Mbps
0 Mbps    38.72 Mbps

The download speed is slightly lower than the 37.44 speed I normally see when running other speed tests.  From what I've read, if I'm on the "38.72" profile, then I *should* benefit from upgrading to Infinity 2.
I'm just a little concerned at the various stories I've read from people who've lost speed when upgrading from Infinity 1 to Infinity 2.  It wouldn't really bother me if we saw no increase, but I wouldn't want to lose any download speed.
As an aside, when I log into my BT account, it says I'm on the 40/10 package (although we originally signed up to the 40/2 package).  However, it looks like my upload speed is capped at 2Mbps, even though the broadband checker estimates more than this.  Not a big issue as I don't upload a great deal.  I was just curious as to why there is still a 2Mbps cap.
