I hope you bought this from a store, you can return it and get your money back. BUT if you bought from a person off the street or off the net, someone you don't know... I'm thinking you just got screwed! And are out the money and have an expensive paper weight. I hope I'm wrong, but I think you have a stolen iPod. If you can find the person that sold it to you return it and get your money back, but I'm thinking they are long gone. If you can not find the person report it to the police and turn it over. You can’t, and Apple won’t do it for you; the activation lock is an anti-theft measure. Try getting a refund for it.

Have you tried resetting your iPod:
Reset iPod touch: Press and hold the On/Off Sleep/Wake button and the Home
button at the same time for at least ten seconds, until the Apple logo appears.
Next would be to unsync the music and then try syncing the songs to the iPod
- Last would be to restore from backup.

You need to use a laptop or a PC. Download and install iTunes. Create an iTunes account and then use the USB cable to connect your iPod to your computer.
Depending on the amount of charge in the battery it may take a few minutes for iTunes and your computer to recognize the iPod.
When iTunes detects your iPod you can give it a name and set up how and what you want iTunes to synch to the iPod.
While you're on line, connecte to the App Store and download the owners manual for your iPod...

Your phone is "activation locked". It cannot be used unless this lock is removed by the previous owner of the iPhone. If the seller can't help you then ask for a refund of your money.
Apple won't help you. Note that the iPhone you bought may well be stolen property..

Take it back. The activation lock is an anti-theft measure and there is no way to bypass it. The seller should have wiped it clean for you and if they can't then it's a very real possibility that the device wasn't theirs to sell in the first place.

My ipod wont even come up in itunes to restore it!
Make sure the battery is charged before trying to restore.
Place the iPod in recovery mode...
iOS: Unable to update or restore
Note: "If you restore on a different computer that was never synced with the device, you will be able to unlock the device for use and remove the passcode, but your data will not be present.
