All you can do is get a newer model iPod. The 2G can only go as high as 4.2.1. Its hardare does not support a higher iOS version

Before buying in App you should read the description carefully. Each App states the requirements and on which platform it will be able to run. And yes, sorry, many of the new Apps require IOS 5, and since they have been compiled for IOS 5 and their code requires the runtime support of the OS, it is impossible to run them on a different OS.
Please could you tell me if there is a way to update it without going via Itunes because a bit of internet research tells me that Apple do it so that you just have to buy a new Ipod. I do not want to do any illegal downloads.

You can upgrade your iPod on itunes to the most recent software it willl support. Anything past that won't work on your device.

I've had my 16 GB ipod touch first generation (With built in WiFi) since it was the newest model out. I would like to update to a newer model but money is tight. I was hoping someone could tell me if, and how, I can update my ipod to the latest software from Apple, so as to get apps and games and an overall fresher feel for the device. It is in very good shape, never damaged or serviced, and I still have close to 3 GB of room on it. I use it 99.5% for music storage and playage. It recognises that its my ipod and says sync completed but there is no music or content on the ipod from my itunes library.

I have this problem.. and after spending time at the Genius Bar yesterday, I discovered that my old ipod touch is obsolete..( the Ipod touch is a 32.bit system, while the newer operating system is 64... so they're simply not compatible.)
I expressed great dismay that my perfectly good ipod touch was now obsolete... then the genius suggested I export my contacts and calendars to Google..
That was easy to do, and then, on the Google community forum i learned about nuevasync.com, which lets you synch all of this back to your ipod touch via Exchange.
WOrked like a charm.
Nuevasync. com is free for an initial trial (10 days?) and then costs only 15$ per YEAR.. so I'll use this as a good work-around

I am not able to use previous apps on my iPod touch 2nd generation or even install new apps cause of this issue. I find it very messed up that Apple is inputting these restrictions, because they want people to buy the latest versions of their gadgets. Not everyone finds it necessary to buy every new version of every technology or even have the money to do so. It is just really disappointing...

There is nothing unusual about this at all.
As with any tv, computer, dvd player, car,etc the older hardware is simply not capable of running the latest software.
This is normal.
The second gen was released over 4 years ago.
