If you're using a first generation iPod touch, it is up to date. The higher iOS versions require a newer model.

I'd report the problem to the iTunes Store.
Log in to the Store. Click on "Account" in your Quick Links. When you're in your Account information screen, go down to Purchase History and click "See all".
Find the item that is not playing properly. If you can't see "Report a Problem" next to the entry, click the "Report a problem" button. Now click the "Report a Problem" link next to the item.
(Not entirely sure what happens after you click that link, but fingers crossed it should be relatively straightforward.)

I know AT&T, Verizon, and Sprint will give you the steps to unlock it as long as the original contract it was bought under has been completed. eBay/Craigslist is really not the best place to try to get "unlocked phones" from, if it turns out the phone isn't unlocked then I'm really sorry you got stuck with that one and as stevejobsfan said above I would report them immediately and see if you can recover your money. There's a couple of ways to get through to the authorisation controls in the 11.0.x versions.
The control is still in the Store menu, but first (if you're using iTunes versions 11.0.x) you might need to bring up the menu bar to see the Store menu.
If you're using 11.0.x, click on the wee boxy icon up in the top-left corner of your iTunes to see the "Show Menu Bar" control, as per the following screenshot:
Then you'll find the control in the Store menu:
Alternatively, if you don't want to bring up the menu bar, it's still possible to get into the authorise controls via nested menus accessible from the wee boxy icon. Here's a screenshot of where to find them:

TS1436 Trying to burn a cd disc and receive error code 4450. What is this error code?

When burning a CD disc, The progress bar doesn't move and then I get an error code: 4450. My computer freezes up and no functions will work. I rebooted and downloaded the latest iTunes update but still receive error code 4450. Anyone have suggestions for me. Thank you for your response.

You can try to disable hardware acceleration in Firefox.

All downloads from iTunes are tied to the account that downloaded it, you can't re-download content via a different account. You checked the spam folder on yourr old account as well as the Inbox, and depending upon how long ago you did it, have you retried getting it reset : http://appleid.apple.com, then 'reset your password' ?
