You are running inot the Activation Lock
iCloud: Find My iPhone Activation Lock in iOS 7
You either have to:
- Get the iCloud ID and password and enter it
- Get the person to disassociate the iPod from his account
Find My iPhone Activation Lock: Removing a device from a previous owner’s account
- Return it for a full refund.
You likely have a stolen or lost iPod if you can't get it activated.
