Settings > Facetime > Apple ID > tap it and log out, log in with other Apple ID

There is nothing you can do about but ask the seller for your money back. Without the previous owners applid password, you cannot activate and use that device - there is no way around that. iOS 7's Activation Lock needs to be disabled by the previous owner in order for you to use it - if they cannot (or willnot) produce the password to disable it, you have no options.
They can disable it remotely for you - see http://support.apple.com/kb/HT5661 but not if they do not remember their own password.

My wife up graded her I phone to an I phone 5 and I just recently got a new Iphone 5 . when I put my apple ID into icloud I used my email address as my ID and one of my passwords. What I did not know is that my wife used my email and the same password for her Apple Id in her phone for I cloud. Now when we sinc our phones the contacts and information gets combined. I have been unable to find a way to change her Apple Id to her email address and also change her password. If she could do this on her phone it would solve our problem. If anyone out there can help me do this I would appreciate it. Thanks

go to settings/icloud and delete the account on th ephone you want to change
Settings/imessage and turn off and turn on again with new ID
Settings/facetime turn off and reactivate with new ID

Itunes says I have backed up my phone to icloud at a previous date. When I log into icloud with the same apple ID and password I use for Itunes it says no data. Now I do not have access to my older phone and I cannot update my newer phone?

On the ipad that you wish to change the ID:
You can Erase all content and settings - that returns it to the "out of box" condition.
OR
Settings - iCloud - Delete account (It will ask if you want to keep contacts, calendars etc).
Settings - Messages - Tap AppleID - Sign out
Settings - Facetime - Tap AppleID - Sign out
Settings - iTunes and App store, tap apple ID, sign out.

Yes you can, and it's then up to you whether to have the same the same or different content to the older one. When you sync to it your computer for the first time it may be best to give it a different name, just so that you can distinguish them.

What do yo mean by: " it will backup on all devices"?
If you mean that is one persone purchases an app it appears on all device then on each device go to Settings>Store and turn off automatic downloads.
