I have recently purchased a macbook 2010, have downloaded os x but it hangs during set up.

I have recently purchased a macbook 2010, while trying to set it up after downloading  os x it hangs (rolling beach ball). I have forced shutdown several times as it gets partially through set ups and then it hangs until i have to force quit again. Can anyone tell me if this is a software or hardware (processor) problem... thanks in advance for your help.
