Apple will send you a new iPod if you send them money. Otherwise, no, they won't, any more than any other company would send you a free product to replace one that was lost or stolen.
Sorry about the theft. As B-Rock said, report it to the police and your school administration. If you had Find My iPod set up on the device (which would require a paid MobileMe subscription), you might be able to track the iPod and give that location information to the police.

The way I did it was I got the free app sync:stream from the App Store and then added my ipod to my ps3's Bluetooth devices. Then went to audio settings and set output and input to 'Skaggs iPod' you then open the app and it will be listed under music as a media service. You then go to all tracks and click copy (press triangle) it will then begin to copy all of your songs onto your ps3 via Bluetooth. I haven't tried but I assume the same can be done with photos. I cracked my iPod screen today, and I want to get it fixed, but I don't know if the Apple store will do it for free. You can't. Apps and really all content purchased/downloaded through one Apple ID is forever tied to that Apple ID. In the case of Apps they will always request that Apple ID to update as they are licensed to that Apple ID.
In reality, the Apps were licensed to that Apple ID by the developer. And cannot simply be given away to you for you to use.
He should have wiped the iPod clean so you could set it up for your use without any of his accounts or purchased content as you are not really licensed to any of those Apps.

Hopefully, you will see a list of all the devices you registered with your Apple ID, including their serial numbers. Let me know how this works out.
Edit to add: If you enabled "find my imac" on your Pro, you ought to be able to remotely lock it, or even wipe its memory. Click http://www.icloud.com/ sign in with your Apple ID and click the big green "find my iPhone" icon (nevermind the name, it will find all your devices provided they're running Lion or iOS 5).

Thanks for answerIf you go to Apple, they will not replace your battery, but exchange your iPod for a refurbished iPod of the same model with a new battery. Therefore you will lose everything that is not backed up. If you change it yourself or have a third party change it, you will most likely not lose anything (but still best to make a backup as lllaass suggested).
