Philosophical/Theoretical/Legal Question re: rights of ownership

I have a MacBookPro that I recently upgraded to Leopard. I assume that I still own 10.4, and would like to install it on an older (G3 CRT iMac DVSE). The disc, however, will not read, and through some posts here on the discussions, I have found that it is "computer specific". While I respect the right of Apple to their intellectual property, I have rights, too. I paid for 10.4 when I paid for my MBP. I paid for 10.5 in full, not an upgrade. I think I should be able to load 10.4 onto any (one) Mac I choose.

I'm sorry, I was wrong. I thought once you owned the disk you could apply it on any system that would allow it. I am sure Klaus1 knows more about this issue than I, and would listen to his advise. I will be more careful with my answers. I do not like to steer people in the wrong direction, and I do not break the law. The more I think about it, it makes sense. You pay for the operating system for a single machine, unless you buy the family pack. My apologies.

  • Legality questions about Home Sharing

    I have some legality questions about Apple's Home Sharing technology.
    As I understand it, you can share (that is, copy it from one computer to another) your music, movies, applications and other iTunes-managed files amongst five computers. The only 'trick' is that each computer must have an iTunes Store account and must be logged in in order for it to work.
    My question concerns the copying aspect and the legality of it. For content that was purchased through the iTunes Store I can see how Home Sharing can provide a limitation on content sharing, since all of the machines would need to be connected to Apple's servers in order for the validation process to happen. But what about content that was added to iTunes through other means, e.g., ripping my own CDs or converting my DVDs? These items can still be copied via Home Sharing and as there's no DRM on them there's no way they can be protected against "illegal" or "unauthorized" use.
    It was my understanding that if I gave a copy of a song to someone else, that's illegal. Apple's Home Sharing technology seems to facilitate this action. If I rip a CD or DVD into iTunes and someone copies it out, isn't that making an illegal copy? Can I be held liable for distribution of content?
    And how far does this extend? If I live in a house with four unrelated people, are they legally (?) allowed to copy music and media amongst each another? Is there a perceived or actual difference between using Home Sharing to copy a movie versus, say, using a USB flash drive? And what if one of them moves out? Am I legally obligated to go through that person's hard drive and remove content that they copied from me before they leave the building?
    Does Home Sharing somehow retroactively change the copyright application on a given CD or DVD? Most of my CDs and DVDs contain notices and warnings against distributing copies. Can these warnings now be ignored, or at least amended with "...unless you're using iTunes Home Sharing" at the ends of them?
    I am not trying to stir up a hornet's nest here. I'm only trying to better understand the legal issues surrounding Home Sharing and particularly how they relate to unprotected content. It seems very contradictory that the RIAA and MPAA would be fighting so hard against peer-to-peer services like BitTorrent and Gnutella while apparently allowing peer-to-peer services through iTunes Home Sharing.
    Furthermore, I also understand that the intention of this system was to allow families who are living together to have common access to all of the "household" music, but my issues aren't about this. I envision, for example, a college dorm building where there's several hundred people living together on the same network subnet, and all of them have Home Sharing enabled and everyone is copying thousands and thousands of songs to/from one another. Is this now legal?

    RIPping of commercial, encrypted DVDs (most of them) is illegal to begin with. Or rather, breaking the encryption on a DVD is illegal and in order to RIP the DVD, you must break the encryption. SO you have already "broken the law" by having a copy on your computer.

    Much of your post has been cussed and discussed by many, many people (lawyers, corporations, organizations, individuals, etc.) and no one has come (or likely ever will come) to a complete agreement.

    This is exactly what Napster was and why they were sued & shut down.
    I imagine Apple lawyers have done their homework as well as consulted with the labels to discuss these exact issues.
    And it's called "Home Sharing" to indicate that it is not "Dorm Sharing" or "Workplace Sharing", or even simply "Library Sharing"etc. even though it may be possible to use it in other places than the Home.
    Users on other computers need to know your iTunes ID and password to enable it Home Sharing. Likely this is how Apple got the lables to be okay with it.
    Are you gonna give (and get) dozens/hundreds/thousands/any other users your iTunesID & password?

    I just received some horrifying news from Adobe about my production suite.  I just FINALLY learned today that what I've been trying to do for over a week now - CAN'T be done because of compatability issues involving updates of both Adobe & Microsucks Winders!!!  I sincerely hope this is not your problem.  Mine is ALMOST HOPELESS!!  Being in this HOPELESS Obamma economy,,,, leaves NO STIMULUS in which to currently upgrade everything that needs upgraded for me to fully use my INVESTMENT in Adobe Suite - sad, horrible and SICKENING!!!

  • Legal Question - Photoshop in rented computer?

    Dear all,
    I have a legal question concerning photoshop: I work in a photo equipment rental company, and one of our services is a digital assistance (for capturing/developing images taken with digital cameras). Normally no computer goes out without an operator (assistant), but we are considering renting the computers themselves for photographers who want to capture/develop their own images.
    My question is this: would I need a special licence for the above scenario?

  • Legal question?

    I'm making a movie in imovie for a company project - not something that will be sold to the public.
    We are planning on having an introduction to this movie using a clip of a song. An employee mentioned to me that it would be OK to use any song, just as long as it's just a clip of the song, and not the full tune.
    Can anyone point me in the right direction on where to find out if this is actually possible? It seems to me that this would be an illegal practice using a copywritten song - even if just a clip, and the fact that I'm not selling this video.
    One more thing, is there a site out there that has free-to-use music for this sort of purpose?

    I'm not a lawyer, over here in Germany we don't even have a "copyright", we have a very diffrent legal concept in ownership of any art...(Urheberrecht= as a creator, you automatically own any rights; you just can sell "usage rights"...)
    but, to my knowledge, it is a urban legend concerning "short parts", <30" pieces etc...- in Germany, we have the concept of "identification" of a track... and Beethoven's "tatatataaa" is recognized in a splitsecond...
    COPYright is far more detailed: you're using a copy... even a few bits = a copy. ok, exceptions (educational usage, science, quoting etc).
    I would NEVER dare on a commercial base to use any copyright material without asking the owner of these rights! trust your local lawyer

  • Just double-checking - a question re. right configuration

    Hi all,
    I would like to ask the experts whether my following network setup is configured correctly (or ideally for that matter).
    We have a flat with a lot of walls between the rooms, so one router is not enough to ensure wifi reception in every room. Thus my current setup is:
    a)
    In one room:
    Internet -> TC (configured using dual wifi networks with different names / 2,4 + 5Ghz) -> + additional connection via LAN Port to Powerline Adaptor / wall socket
    b)
    second room:
    Wall socket / Powerline Adaptor -> Airport Extreme via WAN Port (The AE is in Bridged Mode, the wifi networks are configured exactly the same way/same names as in room #1, but however using different channels than in room #1).
    My questions:
    1) Does this setup reflect an ideal setup in a flat that is so large / with a lot of walls that I need a second router to ensure wifi reception everywhere?
    2) If yes,
         2a)     Using the WAN port instead of the LAN ports on the bridged AE is correct? Or doesn't it make a difference if I use LAN or WAN on the bridged AE?
         2b)     Using the same wifi network name in both rooms (but on different channels) makes sense, right? I figured my end-devices will always choose the                      better router (either TC or AE) depending on where I move about in my flat...

    An ideal setup would use Ethernet cabling between the routers. Powerline Adaptors have a good deal more signal and speed loss....and can be "iffy" as far as reliabiliy.  After all, you are sending an Ethernet signal over the electrical wiring in your home.
    Powerline can work OK in some homes,but not others. You just have to try it out to see how it works in your home. Ethernet cabling always works, and there is no signal loss in a wire.

    When you have an AirPort in Bridge Mode, it makes no difference whether you use the WAN or LAN port(s), since they all behave as LAN ports in Bridge Mode.
    2b)     Using the same wifi network name in both rooms (but on different channels) makes sense, right? I figured my end-devices will always choose the                      better router (either TC or AE) depending on where I move about in my flat...
    Same Wi-Fi nework name, same wireless security, and same password on channels that are separated at least 4-5 settings on the 2.4 GHz band and another channel on the 5 GHz band.
    Most laptops will automatically switch to the AirPort providing the strongest signal as you "walk" them around the house.  But, do not expect iPhones, iPads, etc to do this, as their operating systems are not as sophisticated.
    If you want an iPhone or iPad to pick up the "other" AirPort when you move it around, you usually need to turn off the Wi-Fi on the iPhone, move it, and then turn it back on again. Hopefully, it will pick up the signal from the closer AirPort router.

  • ABAP Development Video legal question

    Dear Community,
    We would like to create something like a video tutorial for ABAP development for the beginner level based on the flight data model. We might simply put it on our websites unrestriced area, membership area or we might sell this as a product.
    The system we are using for this beginner level development activity is the Netweaver Trial version, this is more then enough for this purpose.
    Here comes the question; In the license agreement of the Netweaver ABAP Trial version there is this sentence:
    "The SOFTWARE PRODUCT is "NOT FOR PRODUCTION USE". You may not demonstrate, test, examine, evaluate or otherwise use the Software Product in a live operating environment or with data that has not been sufficiently backed up. "
    I do not fully understand this sentence. Would our activity considered as "production usage" and we might get legal troubles, or a commercial video tutorial is ok?
    If we have a problem here, what could be the workaround? Subscription for a system hosted by SAP or maybe subsciption for a cheaper hosting like eg. www.michaelmanagement.com ?
    I would really appreciate your oppinion.

  • IPhoto's music- legal question

    Hi Guys,
    Just wondering If I can use iPhoto's music in professional Slideshows for Clients- obviously when using iPhoto to put together the slideshows : )?
    The reason I ask is there isn't alot of royalty free music our 'there' that sounds decent.
    Could you please advise me if I can use the default iPhoto music in slide shows for clients?
    BTW, I convert Slides to Digital Images- then clients have the option to get them onto a slide show.

  • Typography legal question?

    I am working a logo for someone and their site is based on a current popular video game.
    The title of their site has the video games title in it and I have worked up a font that resembles very closely the games font, but is in fact created by me.
    I am hoping someone here might know the legal ins and outs of doing such a thing?
    Is it still risking copyright infringement if the font resembles but is not that of another company?
    And otherwise, how far must one change their font before it is then free and clear to be used in this manner?

    You're seeking legal advice, and for that you are best off talking to a lawyer. I'm not a lawyer, and don't even play one on TV. I can recommend some good lawyers who specialize in this general area, notably Frank Martinez (http://www.martinezgroup.com).
    My lay understanding of these things is that the answer depends on several things, including what legal jurisdiction you're in, the vintage of the original typeface, and what legal protections were sought for it in the first place. For example, in the USA, the abstract design of a typeface is only protected if a design patent is obtained. Because of the costs involved, very few typefaces have such protection (as far as I know Adobe is the only foundry to routinely do so, and only in the past 15 years). European countries may often offer greater protection to the abstract design of a typeface, however.
    The actual digital font files are regarded as subject to copyright in the US and apparently in many other countries. But if you didn't start with somebody else's digital file, I imagine you'd be safe on that score.

    Now, there's a separate question in my mind about getting too close to the appearance of the trademarked logo of the video game... but you haven't really told us enough for anybody to tell if that could be an issue.

    Hi all, here's a question for you. If I have a friend who own CS3 and he upgrades to CS4 and sells me the version of CS3 am I a) able to register the used CS3 and b) then on the upgrade route? What is the legality of this? I know Serif actively encourages the selling of old versions and does allow the purchaser onto the upgrade path but they are a much smaller company of course.     The answer is quite simple: You can't do it.
    What Adobe sells is the licence to use it not the software.
    If you friend wanted to sell it he would have to transfer the licence which means he could no longer use it himself.

  • Legal Question Concerning XP Home

    I hope it is okay to ask this but I couldnt find anything on this using Microsoft's website.  I have a single licensed copy of XP I bought 2 years ago, which I installed on my new machine a couple of weeks ago.  Last week, I reformatted my older Atlon 1800XP and did a clean install of XP using the same CD.  Of course now I have to activate it.  I heard that if you used one copy of XP Home on just a couple of machines in your house, it is okay.  Is this true, or am I going to have to purchase a new copy. Right now it will not ativitate the 1800XP's copy and I am thinking of calling Microsoft's activiation line to see if they agree to this.  If not, I might as well try the 64-bit version for my new AMD64.

    I'm trying to find the link to the Article jimboy, And believe Me as they put it, they are NOT Attacking the Illegal PS, as they are merely rendering thier PROPERTY Useless. And I really doubt Microsoft Really Cares about Whether or Not Legal Action was taken against them ..As that is like Calling the Police to say that the Corner Drug Dealer Robbed you, because you Paid him, and you did not recieve Drugs ...All they have to do is Hit a Few Hundered PC's in one part of a Country in Order to get the message across. I mean Lets Face it.   • Legal question - Am I permitted to use the student version for personal business while studying?

    Hello.
    I am currently a digital imaging student and have a student subscription to CC.  I am required to use Photoshop, Bridge, Lightroom etc quite a lot.
    We have started a "freelance photography" unit and we are being encouraged to actually start/register our own businesses.
    I am curious about this...  If I was to start my own photographic/imaging business and got some work, would I be able to use Photoshop etc for this work with only the student membership or would I need to upgrage/repurchase another subscription?
    I could wade through the legal documents but this information does not seem to be very readily available and I'm hoping to fast-track an answer.  I will need to pass on the information to my teachers, as well (they can be a little vague on specific details at times...).

    That's an entirely unhelpful response.
    1.  The computers in question are not "privately owned".
    2a.  The software licensed on those computers is licensed to someone else.
    2b.  The software would actually be licensed under an "educational institution" license not the "student" license.
    I'm asking here because its very likely that my teachers wouldn't know and it would probably take the IT department quite a while to tell me - It'd be more than likely faster to read the legals myself, if I was able to find them. 
    I'm hoping that someone who knows the specifics can inform me.

    My foolish husband put his apple password on a website. Apple has suspended his account. He is not getting the reset password emails and the security questions are not the ones he used.   • Legal Question: Can i use garage band in order to make a profit?

    If for example i am making a movie and i plan on selling it and i want to use garage band for background music can i use it w/o the risk or being sued or something (e.g. copy write laws).
