A500-02F - Locking up random

Question

A got a new Toshiba A500-02F and now it seems to be locking up now and again. seems to do it randomly with in and before login to Windows 7 64 home prem, I'm running a windows drive check right now, memory 86 later, anything else to check before contacting the store that stole me this gem?  It's the second time it's done this but it's worrying me now because it just starts getting slow and locks up.
Today it locked up on the startup screen at user login.
5:28pm update, ran a scan disk and found nothing wrong, so I ran some virus software and spyware apps, Malwarebytes' Anti-Malware, SUPERAntiSpyware Free Edition found nothing but did scare me when the computer would scan but the screen after 30 or so mins would go black and then I couldn't get the notebook to come out of sleep mode. turned all of the sleep mode stuff off and the scans ran fine but shouln't there be a setting for it to not go into sleep mode if stuff is happening? or will I have to turn that off everytime I scan my system?

ya i'll give that a try the bios update but I also noticed something else odd. it started randomly starting media player on start up. every now and again Windows Media player starts on start up. but then sometimes it doesn't do this. I have my labtop connected to a monitor and a wireless keyboard and I am thinking it maybe one of those Multimedia keyboard buttons that's loading it. or miss loading it in this case. but not sure.
I got the blue screen again last night, third time it's done this.
