Alchemy for commercial usage

Hi everyone,
I'm planning to port some C-based computer vision code I wrote to Flash using Alchemy for a customer project (who wants to sell it) and I'm wondering about the commercial terms for this case. Unfortunately I haven't found much information on that issue, maybe you forum users can shed some light on this dark spot.
I know that Adobe's General Terms of Use forbids the use of pre-release software for production use whereas according to information on the Alchemy website the production use is just not advised (unfortunately the general terms seam to be stronger). Is there any official or unofficial statement from Adobe? Who is responsible at Adobe for such questions?
Thanks in advance,
c.

Hello,
I sent an email to the person who helped crafting the Alchemy EULA but she is on vacation until 8/9.
I can't give any legal advice but I believe the intent of the Alchemy EULA is that you are allowed to use Alchemy in commercial products.
Do I understand you correctly that you are more concerned about the wording in the General Terms of Use that is attached to every Adobe Labs project?
Would you please clarify which part of what EULA you are referring to?
I found three legal texts:
Alchemy's EULA:
http://labs.adobe.com/technologies/eula/alchemy.html
General Terms of Use:
http://www.adobe.com/misc/terms.html
Online Privacy Policy
http://www.adobe.com/misc/privacy.html
Best regards,
- Bernd

Can we use for commercial purposes while we are studying?
    How about after we graduate?
    Thank you.

Check your regional S&T pages for specifics. Generally commercial usage is allowed during school and after graduating, but in some regions extra restrictions may apply if e.g. your software is subsidized by your government or the license owned by the school and you just "loaned" it.

  • Can i use a font such as Yuppy, Chalkboard which is basically included in iOS  for commercial purpose?

    hi!
I make a e-book and it will be published on appstore and android market as application.
    I'm wondering about font.
Can i use a font such as Yuppy, Chalkboard which is basically included in iOS  for commercial purpose like me?
I bought a mountain lion on appstore.
I look forward to hearing from apple whether it is lawful or not.
    Have a blessed day~:)

Strangely, there isn't and end user license on Apple's site regarding iOS. But here's a look at the font agreement section from OS X Mountain Lion:
    E. Fonts. Subject to the terms and conditions of this License, you may use the fonts included with the Apple Software to display and print content while running the Apple Software; however, you may only embed fonts in content if that is permitted by the embedding restrictions accompanying the font in question. These embedding restrictions can be found in the Font Book/Preview/Show Font Info panel.
So basically, you need to examine the fonts to see if there are notes on usage restrictions or limitations.

  • Sound effect licensed for commercial use?

Are the sound effects licensed for commercial and distribution usage? thanks.
      Mac OS X (10.4.10)

    Found this eventually.
    http://images.apple.com/finalcutstudio/docs/20070415FinalCut_Studio_2_ProductOverview.pdf
On page 44 of that apple PDF it states:
“Soundtrack Pro 2 includes a library of more than 1000 royalty-free surround music beds and sound effects. These professionally produced and recorded elements make it easy
to get started fast and keep quality high when you create a surround sound mix. The library also includes 5000 royalty-free Foley, sound effect, and music segments for stereo use. Easily add third-party music and effect libraries when you want more options.”

  • Student/Teacher edition for commercial use?

I received the student/teacher version of the CS6 Master collection from my school which I am currently enrolled at and I have recently started a production company with some colleagues and will be heavily using Premier Pro, After Effects and other applications for our business. We will be making money for our services so my question is will it be ok for me to use the student/teacher edition or will I need to get a CC subscription for commercial use?
    Thanks!
    Richard

is will it be ok for me to use the student/teacher edition
    Yes.
    Best explained here:
    http://prodesigntools.com/difference-between-adobe-cs5-student-editions-vs-regular.html
"Since Creative Suite 5, all Student and Teacher Editions can be utilized for personal as well as commercial use, for all academic customers worldwide. So yes, you can sell your services or anything you create, or use these products in developing a side business or online venture. And after graduation or completion of coursework, you can continue to use the perpetual software on your personal systems; there is no usage expiration and those tools will continue to work."
    Adobe's version: http://helpx.adobe.com/x-productkb/policy-pricing/education-faq.html
"Can I use Student and Teacher Edition products commercially?
Yes, Student and Teacher Edition products can be used commercially on your privately owned computer. They may not be resold."

  • Is it FREE for commercial use?

    Dear all,
Has been using Skype for the past few years, and mostly for my personal usage.
Just to clarify something about Skype Licensing, is it FREE for commercial use? For example, I myself and my current/ex colleagues are using Skype for working related purposes, be it just texting or calls or video calls. Do we need to purchase licenses/subscription for commercial use? For your reference, we're from Malaysia.
Appreciate if anyone there care to explain on this matter.

I would start by looking at Oracle information - while we can provide hints and give guidance, Oracle is the only legal source for license information.
My suggestion in general is to use the Oracle site and the Oracle docs, and take a hard copy of that information as backup in case of legal challenges.

  • Using system fonts for commercial printing?

    Hi,
Does anyone know the licensing rights/usage for using system fonts for commercial printing? If I understand correctly, system fonts that comes from operating system CAN be use because Apple purchase the rights on them and end users that purchase OS can use these fonts freely as long as not we are not redistributing them for profit, etc.
Can anyone point me in the right direction with official documentation on the subject?
    Thanks!

Never mind, I found the answer. It's in Apple's OS EULA.

  • HT1879 Buy music for commercial use.

I have a question. If I buy a music (0.99€) I can use it to commercial videos, for example I want to make a video with 3 minutes and I want to show my film to others.
    Thanks

No, you cannot. Tracks from the iTunes Store are sold for your personal use only:
    USAGE RULES
You shall be authorised to use iTunes Products only for personal, noncommercial use.
Nor could you use any tracks, even from a CD, for commercial purposes without a license from the record company or whoever else holds the rights to the track. I'd suggest that unless you really, really want to use a commercially-released track and are prepared to pay handsomely for the privilege, you obtain your music from one of the several companies that sell royalty-free tracks.
    Regards.

  • When Will iTunes U be Available for Commercial Training?

With full understanding the current (as of Dec 2012) iTunes U policy allows for only:
"K-12 school districts, universities, and colleges in 26 countries can enroll in iTunes U to distribute courses and collections of education content that anyone can access."
When will iTunes U (or, something similar) be available for
    Commercial Training purposes?!?!?!?
As an All-Apple educator/trainer/author/speaker...I know there are many, many, many of us who would put iTunes U-like resources to immediate use in a commerical-context (of course, assuming content access can be appropriately restricted to authorized users).
WOULD AN AUTHORITATIVE Apple representative please REPLY?
Time-is-of-the-Essence: Many trainers (including myself) are preparing 2013 materials...some of us want to use iTunes-U...we would gladly create valuable content on the platform...OR—we're going to have to go the Kindle-route...and make this year+ spanning election quite soon.
    All Commerical Trainers—
You are invited, welcomed, encouraged, requested and otherwise & in all ways, inveigled to post a comment below and demonstrate your interest a Commercial Training version of iTunes U.

We are all just fellow users here and have no insights into Apple's future plans for iTunes U. I've seen nothing to indicate that they plan to open it up to commercial usage, but nothing is impossible. The best way to submit comments to Apple is via their feedback pages:

  • Oracle 11g express edition for commercial use

    Hello everybody,
does anybody know if i can use 11g or even 10g express edition for commercial use?
    What i mean is:
-Can i use it inside my company to store customers, supplies etc?
-Can i develop an application on it and sell it to another one?
    Thank,
    Mike

    Hi Mike,
for me the license agreement wasn't totally clear in some areas and after a misunderstanding with Oracle Sales in Germany I decided to talk to Oracle Product Management, here is the answer: http://daust.blogspot.de/2012/08/clarification-on-oracle-xe-licensing.html
It is definitely free for all commercial usages.
    Cheers,

  • Commercial usage of fonts.

    Dear!
I am writting to You to ask a question regarding usage of the MAC OS X system fonts.
Is it both possible and free to use system fonts in developed mobile application. Potential users will of course need to download the application from Appstore. The fonts used to create will not be distributed within this particular application (embedded).
What is the Apple stance on this matter??
Thanks in advance for your answer.
PS. Didn't know where to put this topic, forgive me if it's not the right one.
    Kind Regards

If you're using Xcode and Objective-C or Swift and not using private APIs, any font you can access via the SDK is ok to use in your app, for commercial use or otherwise.
