Am I Entitled To A New iPod Under These Circumstances.

First of all, Hi guys I'm new to these forums I hope that I help you all as I hope you can answer some of my queries
I'm a fanatic Apple Fan, I have bought over 6 different iPod, just bought the new iMac 20inch 2.4ghz and have purchased loads of other extra software and hardware.
__Right here is my question...__
I purchased the new iPod nano 3rd gen PRODUCT(RED) 8GB from the apple website about 40 days ago, I also got my name on the back (If this changes anything). The iPod was in my bag and unfortunately later when getting it out, I discovered that there was a crack in the screen, the was a black mark across the screen caused by the crack. Although the product still turns on and does play music It is very difficult to navigate around the nano and I cannot see what is playing.
I was not please with the product overall and I would prefer to swap the product back in and pay the extra $100 and get the iPod touch.Under the circumstances, with apples free 90 day protection, am I entitled to do so? If not what "damages" would the iPod have to of sustained to be entitled to the swap?
ALSO: What number must I phone to speak to someone who I could explain the situation and I could arrange the exchange (if possible) or discuss other options. (im located in the UK)

The warranty doesn't cover accidental damage, it covers manufacturing defects. I think it's unlikely that Apple will accept that it was defective since it wasn't cracked when you received it. I suspect they'll put this down to accidental damage that occurred while the iPod was in your bag.     Does both your Windows and Macbook iTunes have the same library of songs?
    if it  does then, much easier to proceed, else try to load the Macbook with the same library as Windows.
    Note that only one of the Macbook USB port is good for iPod Classic, the other is too slow and may cause timeout, and I would suggest disconnect all other USB devices, while you Restore or Sync the iPod Classic.
    Connect the iPod to the Mac, (if iTunes launch, please close it back.)
    Use Disk Utility -> select the iPod Device->First Aid->Repair (use option FAT32)
    After the Repair complete, eject the iPod.
    Connect back to the Mac
    When iTunes launch, Restore the iPod when Prompted, (use FAT32)
    Sync your library.

    Have you tried another computer? This will help determine if yo have an Pod or computer problem.

    The only songs you can restore from the external drive are the ones on it.
    The iTunes update will not affect your ability to copy the songs
    An external drive is not an iPod and copying songs from it back into iTunes will not erase any songs on the drive.
    It would help if you told us what happened to your computer that's the only way we can tell if your music can be recovered.

    There is no such thing as a "sub-account."  Also, you probably mean iTunes library, when you say "account."  Your "account" in iTunes is your Apple ID, which is what you use to sign in to the iTunes Store to make purchases.  iPods are associated with an iTunes library, not with an Apple ID (iTunes Store account).  You'll need to clarify...
    So, this is what I think you are saying.  You previously shared an iTunes library on a computer with your friend.  Your old iPod was synced to that iTunes library. 
    You got an iPhone, and at that time, you set up your own iTunes library.  Is that on a different computer?  How does the iPhone affect your question about the iPod?
    You got a new iPod.  What is your "old iTunes"?  Is that the iTunes library you shared with your friend?

    All you have to do is connect your new iPod to the computer that has the library for your old iPod.
    When iTunes comes up, click on your new iPod under Devices.
    At the top of the Summary Page click Music.
    Click Synch Music.
    Do the same thing for Photos, Apps, Movies and so on...
    Now just synch the iPod.

    Put all the music on one computer, make sure it is authorized for all accounts, sync.

    There is no "adding" a device.  Simply plug the iDevice into the computer.  iTunes should automatically detect the device when it is connected.
    iTunes can sync/manage as many iDevices as you want... there is no 1 device limit.

    I have been bought a new iPod touch to put all my existing CDs onto. We already have iTunes from a previous iPod, and on connecting the touch to the Windows XP machine, all I got was the "install new hardware" screen, asking for a CD, which of course, Apple dont provide.
    I checked the support pages, and it recommended installing the latest iTunes. I attempted to do this, and it wiped my registry, passwords, and killed the wireless link. After spending a day re-setting all this, and finally installing iTunes again (10.5 I think), the same thing happens - connect the touch via the USB cable, and "install new hardware" appears requesting a driver from the Apple CD.
    Again, been on the support site to find help, and the only article I have found is to use MSCONFIG to turn everything off. I did this, but (surprise, surprise) it doesnt work.
    So I am now stuck with a half dead Windows XP machine that works with the old iPod, and an iPod touch that works with nothing.
    Other than returning the iPod touch to the retailer, what options do I have ?

    Sorry for the gap in replying.
    Funny you should highlight that link, because it states on it that they dont expect a re-install to work under Windows, and ... you guessed it ... it didnt work !
    I have tried re-installing it again and again, and I gave up. I kept getting a message that the previous install of iTunes failed, and that I had to complete THAT before I could un-install it - useful.
    So, like I said, I gave up. I think re-installing for three weeks is enough.

    It sounds like you need to set it up, and that makes sense because you said that its a new iPod. Just go through the steps of setting up a new iPod and you should be good.

    If you have iTunes 11 on your computer then you can enable the left-hand sidebar on it via option-command-S on a Mac, control-S on a PC - when connected (and if your computer's iTunes is up-to-date) your iPad should then appear on that sidebar under a 'Devices' heading :
    If you select the iPad on that sidebar you can then use the Movies tab on the right-hand side of the iTunes screen to select and sync that film to your iPad's Videos app.
