Bad replacement ipod touch 4G

I had my iPod Touch 4G over 21/2 years. It worked great. I ALWAYS had wifi turned on. I could go a couple of days without a charge if I turned it off at night.
I needed to replace the battery and Apple gave my another iPod for the cost of a battery. I knew it might be refurbished.The first day I had it I was shocked when I went to use it and it was almost dead. I hadn't even used it.
Same thing the next day. I then turned off wifi for a test the next day and great battery live. Could I have gotton a dud?

Sure.  Call Apple.
I would first charge it overnight using an Apple wall-mount charger if available.  If you must use a computer's USP port, use one directly on the CPU, not the keyboard.

    I'm hoping I can get some advice. My 32 GB iPod Touch 5 that I had was having problems running apps (more than normal), so I went to The Apple Store at a mall. The person at the Genius Bar was able to replace it, and assured me it was a new, working device. So I had that set up, received my replacement iPod Touch 5, and was on my way home. I bought a screen protector, had it applied, and tried setting up my "new" iPod Touch 5. I went to the search tab in the App Store, and wasn't able to view all the apps that I searched for, due to the reason that for some odd reason, according to Apple, my device was malfunctioning. I did the reset, restore, etc. and nothing fixed it. I've had this replacement for 2 days now, and I'm in warranty. But that doesn't change the fact that now I would have to wait 1 week or so, to have a working device. My problem:
    1. The Apple Store in the mall is an hour away, and I don't drive. Nor can I get a ride from a friend/family member.
    2. If I sent it in, I don't believe they would replace my screen protector I JUST had applied yesterday. (I didn't test out the device, because I was under the impression from the Apple "Genius" that it worked perfectly.)
    Either way, either of these options will cost more than I should have to pay, (Gas=$$$ and sending in=-$20.)
    I don't think it would be too much to ask for some kind of compensation out of this deal, when I got back a product faulty from the beginning, but I'm not sure. What should I do?

    Make an appointment at the Genius Bar of an Apple store. Be nice but firm. Ask for some compensation but do not go overboard.

    If she wants it like her old one the previous backup, if there is anything she wants to change though, now would be a perfect time to just resync it and start over. It really depends on what she wants.

    I just got a new replacement ipod touch 2 weeks ago . It freezes every few sec but weird thing is that i think it is just the keyboard because it responds to the home button. This happens with like every app that needs a keyboard. Another weird thing is that this problem goes away and then comes back. And i lose wifi when this happens too.     There are some major problems with this ipod. I know everyone says this, but restoring from a backup might help.
    You could also make an appointment with a Genious at an apple store, if you live near one. They might be able to fix this better than someone on the forums. These appointments are free!!

    I had to get a replacement iPod touch as mine was defective. My question is, when I plug the new touch into iTunes for the first time, how will iTunes know that I purchased the upgrade and an app? I assume iTunes looks for the iPod via a serial number, not a name. I am concerned that when I sync, iTunes will assume it's a new iPod (which it is) and I will have to buy the upgrade all over again.

    Accidential damage is not covered under warranty. Apple will still replace your iPod (with a refurbished one) but you will have to pay for it.

    - Also try DFU mode after try recovery mode

    - Try on another computer

    I know this is an often-encountered problem, but I am tired of searching... I had to replace the hard drive on my MacBook after 14 months of service (that's another topic of discussion), I want to now sync my info on the iPod Touch with my computer, especially Address Book and iCal, but it doesn't show up in the Devices list. I have tried holding the Shift + Control keys on opening iTunes to no avail. What can I do?

    Sorry, this is stupid, but I just reinstalled iTunes and it worked! Don't ask me why. I deleted the iTunes app that the guy at the store had installed, downloaded a new app and reinstalled it and it worked. Even while installing it my iPod Touch beeped and as soon as iTunes was installed it showed up in Devices. I synced the iPod with iTunes, making sure to fusion the data rather than replace the iPod data with the Mac Library. It took awhile because I have almost 3000 entries in my Contacts, but the Address Book was filled up along with iCal, so I am up and running again. Whew! I must add that I had updated the existing iTunes to the latest version, but that had not worked, so you have to completely reinstall. Now, on with the discussion of how a hard drive in a 1 year old MacBook could break and lose all its data...
