Bought phone but don't have password to reset it

So I bought a iphone and I thought it was already reset but it wasn't so when I went to reset it, it asked for the password which I don't have. I messaged the person who I bought it from and they gave me the password, well it waa incorrect so I asked again and told him it was the wrong password and never got a message back. So then I tried resetting it iTunes BUT find my phone was enabled and of course a password is needed to disable it otherwise iTunes won't reset it. The phone has been sitting in a drawer because it's useless. Does anybody know anything else I can try?

It was partially my fault for not looking at it carefully before buying. I think it might be stolen even because his name is Alex Jacob and the Apple ID email says Dylan?

Use it as a paperweight, as there is no way around Activation Lock, & Apple will not help you.

What password? Did you encrypt your backup & now can't remember the encrypted backup passcode? If so, no, you won't be able to use that backup. If on a Mac, & you elected to save the passcode to your Keychain, you can recover it from that. Otherwise, you'll have to delete the backup. The data is unrecoverable.
Or, are you talking about the iPhone passcode?

In future you must verify that 'Find My iPhone' is switched off, that is the key to all the security. If it is on you will not be able to get around it unless (a) you have the seller demonstrate that it is off by showing you that it has been disabled or (b) have the seller go to his account on the iCloud website, then go to Find My Phone (on the site) and remove the item from his account. In your case I would guess that the first method would be preferable.
The one you have can be sold for parts value, but that's about it, sorry to bear the news.
PS: You are not the first Pawn Shop operator to post here with this problem. I don't know your business but if there is some kind of trade publication this may be a good item for it (and it is already spreading to other manufacturers devices), Galaxy G5's have a similar system, the EU will require it by law. Thank you for reply, but i am not sure if you understand me. Why "non-devel" devices come crippled, non-developers don't have rights for manipulating with own device? Why Mozilla participating on delivery crippled device? Or why Mozilla recommended crippled devices on their websites?
The main problem isn't "my phone isn't rooted" but "Devices are sold crippled"
For example I have stored lot of sms/mms in my Firefox OS "non-devel" phone, how can backup it? (to SD card, to Computer ...) I read some how-tos but all failed, I Thinks all failed on non-root right, any tricks?

Nothing you can do, if you the seller won't respond to you. Sell it back on Ebay. Lesson learned, only buy iphone from an authorized apple dealer.

Is there any way at all I can get that deleted data from the phone?

Since it has always been very basic to backup your computer and all it's data, Apple provides no way for you to transfer music from your iPhone back to your computer. As you know, you can re-download all iTunes purchases, but music that you ripped yourself you'll have to just re-rip again.
You can try and find 3rd party applications that might help you. I'm sure you'll pay, however.
Let this be a very important lesson learned.

Any content that is currently on the phone will be tied to the account that bought/downloaded it (so you won't be able to update any of its apps or copy its content to your computer's iTunes). You can log out of the currently logged in account by tapping on the id in Settings > Store (Settings > iTunes & App Stores if it's on iOS 6) and you can then do Settings > General > Reset > Erase All Content And Settings to remove all of the previous owner's content - you can then log in with your own account on it and copy your own content onto it from your computer's iTunes

In your spare time you can sort out the license issue and cancel the plan later on if this is fixed.
If you don't want to go there, then you will have to call Customer Service by phone and hope they can fix this.

You need to ask Apple to reset your security questions. To do this, click here and pick a method; if that page doesn't list one for your country or you're unable to call, fill out and submit this form.
They wouldn't be security questions if they could be bypassed without Apple verifying your identity.

If the old ID is yours, and if it is an earlier version of your current ID, go to https://appleid.apple.com, click Manage my Apple ID and sign in with your current iCloud ID. Click edit next to the primary email account, change it back to your old email address and save the change. Then edit the name of the account to change it back to your old email address. You can now use your current password to turn off Find My iDevice, even though it prompts you for the password for your old account ID. Then save any photo stream photos that you wish to keep to your camera roll. When finished go to Settings>iCloud, tap Delete Account and choose Delete from My iDevice when prompted (your iCloud data will still be in iCloud). Next, go back to https://appleid.apple.com and change your primary email address and iCloud ID name back to the way it was. Now you can go to Settings>iCloud and sign in with your current iCloud ID and password.

Try this:
1. Open "Finder", then navigate to "Movies" on the left side. Click on "iMovie Projects"
2. Move desired movies and clips to trash, or your flash drive.
*PS* Its dangerous to have a full hard drive, I would recommend either trashing, or transferring files to another computer. Trash applications you no longer use as well.
