Brand new and sealed replacement battery has 3 cycles already...

Hi all,
I have had my MacBook Pro since April 2007 and noticed diminished battery performance lately. I used iStat Pro which notified (via System Profiler) that it has completed 395 cycles. Upon further investigation I found out they are only supposed to do 300 hence why I was being fed back that the battery health was 33% and that Snow Leopard suggested I replace the battery.
As I type this I am giving my new battery it first full charge, however have noticed it has 3 cycles already? Why is this and is it normal?

No exactly. The Apple statement referring to "300" cycles says:
Battery Lifespan: For Apple notebooks with removable batteries — such as previous generation MacBook and MacBook Pro computers — a properly maintained battery is designed to retain up to 80% of its original capacity at 300 full charge and discharge cycles. You may choose to replace your battery when it no longer holds sufficient charge to meet your needs.
Like yours, many have lasted longer--some much longer.
I would not worry about the cycle count on a new battery. Mine had two after being replaced by an AASP who wanted to test the new battery in my computer before returning it. If anything, your battery may have been tested subsequent to manufacture but before shipping, probably a good thing.

    cd or no cd would make no difference.
    are you seeing an invalid serial number message?  are you seeing an excess activation count message?  something else?
    attaching a screenshot of the message would remove the ambiguity.

    re-read the article and see if your mac has a battery that needs to be calibrated.  If it says it has a pre-calibrated battery, don't calibrate it, it is not necessary.

    Doesnt this mean this a returned/refurbished iphone? it was sold as brand new

    If you are trying to restore to an iCloud backup, this has to be done during the initial setup process.  If your phone is already set up, you will have to go back to Settings>General>Reset and tap Erase All Content & Settings, then go back through the setup screens again and when given the option, choose Restore from iCloud Backup (see image below).  Be sure your phone is connected to wifi and your charger as this will take some time to complete.
    Also, your replacement phone must be running the same iOS version or higher to restore to your backup.  If you are running an older version of iOS than the device that was backed up, your backup will not be visible when you choose to restore to your iCloud backup.  If this is the case, you'll have to update your replacement phone first.

    When you take this one back, be sure to have your USB docking cable checked, to make sure it is not  the thing that is defective.
    Also, make sure you have USB cable plug completely inserted into the headphones jack.  The fit is sometimes tighter than expected, especially when the shuffle is new.  This is apparently enough of an" issue" that Apple has a tech support doc about it

    usually there are multiple models of MacBook Pro per model number, but in the case of your model number (A1502), there’s currently only one model for that model number: 13-inch Late 2013.
    To reset your MacBook Pro, you’ll need to boot into Recovery mode by holding down a Command key and the R key as you start it up. When the Mac OS X Utilities menu appears, select Disk Utility. On the left-hand side of the Disk Utility window, select your internal disk (most likely the top item of the list). On the right-hand side, select the Erase tab. For the Format dropdown, select “Mac OS Extended (Journaled)”. For the Name input box, “Macintosh HD” has traditionally been the default name — I don’t know if that’s still the case for the Late 2013 models. After that, press the Erase… button, and erase its entire internal disk. When it’s finished with the erasure, exit Disk Utility, and select Shut Down from the Apple menu. When you start it up again, OS X Internet Recovery will redownload Mavericks from Apple’s servers and reïnstall it on your internal disk. Once it has reïnstalled, run Software Update to get it up to date, and adjust the System Preferences to your taste.

    I don't think that is normal behavior. The long press is possibly causing the system to force power down, which would then allow it to power back up.
    Just to make sure, all drivers are up-to-date? Are there pending BIOS updates? If so, you'll want to make sure it can restart properly before applying the BIOS update
    Try an Ubuntu LiveUSB or LiveCD to rule out software issues.
    If that doesn't work, try taking out the battery and AC, pressing the power button ten times, then holding it for ten. This is usually the remedy for another issue, but try it anyway.
    If that doesn't work, then try resetting the BIOS settings. Then try unplugging the CMOS battery overnight. Otherwise, might have to call for warranty.

    Warranty? You have to conntact the place where you got it.
    To know if it's not been used yet, Go to the Phone App> Swipe down from the top screen> Settings> Call Summary.
    if the number there doesn't match your personal use since purchase, you will know it has been used before.

    Re-sync your apps and content from iTunes on your computer or redownload it from the iTunes Store, then restore from your backup:

    That should put back most if not all of your settings and data. As to putting songs on, either purchase them from the iTunes Store or, again, sync them from iTunes:

    You may just want to save yourself any possible issues
    by just hooking up a wired keyboard and mouse on first
    start up.  Any USB keyboard and mouse should work.
    There have been many that have had problems on first boot
    using the Bluetooth devices.
