Can I backup my iPhone if i set it up as a new one but backed it up recently?

Okay heres the deal,
      I got a new iPhone two days ago and yesterday it was causing problems so when I called to get it fixed they made me back it up to my iCloud but they made me set it up as a new phone. Now I am wondering if I can somehow access that information and restore my phone without having to reset it again.

Yes, on the phone go to Settings/General/Reset and tap Erase all content and settings. The reset should complete in about 10 seconds, then the phone will prompt you to restore from iCloud. Connect it to power when doing this, as the Restore can use a lot of battery reserve.

    So far so good, my iPhone is in perfect conditions, with no scratches, nothing of that sort... I was informed that this procedure would take at least 2 to 3 weeks to get the replacement, if in fact the phone is dead... When I asked if I could be informed of what originated that situation, some kind of report or explanation, I was told that the information is not transmited to the client. The thing that upset me was, when I asked the employee if I was in fact getting a new phone, he told me that the phone is presented as new but that it is in fact a refurbished iPhone.
    I'm really upset, I'm trying to contact Apple directly to sort this issue, it seems surreal that I bought a new phone, seven months latter a problem occurs and it needs to be replaced only to be replaced by a "fake" new iPhone. Is this for real? Is this what Apple does?
    I need some sort of clarification, I've always been a loyal and satisfied client, but this shook my confidence in Apple.
    I just need a clarification. I'm really hopping this is was a big misunderstanding and a new iPhone is a NEW iPhone.

    My questions is, wouldn't it be more plausible to fix my phone? Instead, they are giving me a supposed New phone instead of fixing mine. It's not the same, as I've read in other post, of costumer going to the Apple Store and having their phone replaced on the spot. Mine was sent to Spain, for, at least, 2 to 3 weeks (maybe more) just to get a refurbished phone, calling it a new phone, when it's not.
    When my computer had a problem, the motherboard was replaced for a new one, they didn't replaced my computer for a refurbished one. They fixed the problem.
    The notion that I'm getting a Phone that had problems already, that problably not all the parts were substituted (specially the battery), instead of fixing my own, remember, I wont have my phone for, at least, 2 to 3 weeks. Is more than enough time to fix my phone.
    I think this is absurd, you never know what sort of problems the "New" not new phone already has...

    Photos would be in your backup. If you did not have a backup of the device since October, and had photos since that time, unless you had imported them to the computer, then they are gone. When you sync the phone, it does not do anything with photos except put them in a backup. But if you are syncing regularly, you should have a backup newer than October. What exactly were you doing when you do this "sync".

    Your phone needs more storage, buying storage on iCloud.com doesn't change that.
    Delete some of the stuff off of your phone, it's full.

    No sorry. You need to upgrade to v10.5 Leopard (minimum) in order to sync an iPhone 4.
    iPhone minimum requirements:
    Mac computer with USB 2.0 port
    Mac OS X v10.5.8 or later
    iTunes 10.1 or later
    iTunes Store account
    Internet access
    You can upgrade to Leopard if your Mac meets v10.5 requirements.

    Once the Device is asking to be Restored with iTunes... it is too late to save anything... and you must continue with the Recovery...

    Sounds like your phone is in recovery mode.  In this case, all data on it is gone.  There's nothing to back up.

    If you want to see how big the backup is for your phone go Settings -> iCloud -> Storage & Backup -> Manage storage and up the too it will tell you how large the backup files are for your phone. :)

    If you mean you want to restore from an iCloud backup, go to Settings>General>Reset>Erase All Content and Settings, then go through the setup assistant again and when given the option choose to Restore from iCloud Backup (see http://support.apple.com/kb/HT1766).

    Not photos, just data synced with iCloud shown in Settings>iCloud.  If you don't have sufficient storage to back up to iCloud, back up to your computer instead using iTunes (connect you phone to your computer, open iTunes, click on the name of your phone in iTunes, go to ths Summary tab of your iTunes sync settings and click Back Up Now).  Also transfer your purchases to your iTunes library (connect your phone to your computer, open iTunes and go to File>Devices>Transfer Purchases). If you have photo stream photos older than 30 days tha you wan to save, save these to your camera roll before backing up (tap Select, tap the photos, tap the share icon -- box with upward facing arrow, then tap Save to Camera Roll).
    When setting up your new phone, when given the option choose Restore from iTunes Backup and restore the backup you made earlier.
