If you restored to factory settings/new iPod via iTunes (Not via Settings>General>Reset>Erase all Content and Setting) and still have the problem that indicates a hardware problem.

Note that you can only redownload the current version from the App store.
Many developers when they updated their apps to support iOS 5 and 6 dropped compatibility for iOS 4.2.1 and earlier.
Thus, if yo have a 2G or 1G iPod Your only way is if you have the version that was compatible on your computer such as in the recycle bin/trash or in a computer file backup. In that case delete the current version that is in your iTunes App library and replace it with the older version. Then sync.

i backed up my ipod this afternoon ready to update the software, i havent actually used it ages and its never been updated, so made sure i followed everything to the letter, after updating the ipod, i resorted from the saved back up, but when i checked the ipod later it didnt have any music on it, and it seems all my music has been whipped off and not backed up, please tell me i can get it all back as i had pretty much every album ive even own saved on there and dont have the cds anymore

You are out of luck for non-Tunes purchases. The iPod backup that iTunes makes does not included synced media like apps and music.

You can restore the phone and when prompted to restore choose from icloud account. BUT MAKE SURE there is 1.) an icloud backup for your phone. 2.) you are using the same apple id.

You can find the backup files and then copy them to a safe place if you are worrying about this.
iTunes places the backup files in these places:
Mac: ~/Library/Application Support/MobileSync/Backup/
The "~" represents your Home folder. If you don't see Library in your Home folder, hold Option and click the Go menu.

But not sure how to do that. When I open iTunes it has a button that say "Back Up iPhone", but I'm not sure what that does. When I go into the sync options it say I have another user account and asks me if I want to merge of replace. I'm assuming it's trying to tell me I have an older iTunes Library, but don't know that. Geez, maybe people over 60 shouldn't have iPhones, iTunes just bafles me.
