i have th 4s and i love it, but i really want to upgrade, but at the same time don't have the money to full out by a new one. a few people have told me that apple is going to start a 'trade in program' so i was wondering if that was just rumors or if it was truth. if it's the truth i definitely want in!

Apple will exchange your iPod for a refurbished one for this price. They do not fix yours. Cost depends upon model and capacity and you get the same model/capacity back

There are plenty of companies that purchase used equipment. I'm not personally aware of who would take it in trade. If you sell it outright, you'll get more money for it anyway....

Only way to get it back is to restore your phone from a backup, if those pics were included in that backup.
But most likely those pics are gone.
What you should've done was import http://support.apple.com/kb/HT4083 the pics to your computer and after you restored from your old backup, you could sync those new pics to your phone via itunes.

I don't use iCloud back up, but I understand you can do that.
It's always better to use a mac/PC based back up, I'd only consider the iCloud back up if I didn't have a mac.

Pictures are held in the iPhone backup. If you backup the old device just prior to the activation of the new one, then restore from that backup, the photos will be there. Music is in iTunes on the computer and when you do the restore, it will download the music from iTunes to the device during the restore. Make sure any music purchased on the iPhone that has not been transfered to iTunes on the computer is done before beginning the restore.

No trade-in. I just sell mine [on ebay] a few weeks before the newer version comes out, or right after. they go for quite a bit if they are in nice condition.
