Can't Download Apps on 1st Generation Ipod Touch

My first generation Ipod is updated to software 3.1.3. I can't download the new software because my Ipod is too old. Whenever I try to download apps it says I need to update my Ipod software, but I can't. So will I never be able to download apps with my Ipod again?

I too have a 1st gen and running 3.1.3. I've tried to download various apps and get the banner warning. What really is disappointing is the fact 2nd gen and up is supported. There really wasn't much of a time difference in the release dates so this is another example of apple FORCING it''s bread and butter to keep shelling out cash. I've resorted to just using this thing for what it is. A MP3 player. When it dies, I'll start using my Android phone for music. My 4 teens have all been told, make your ipod last as I'm not buying a replacement. Those who have drunk their kookaid I hope suffer a hardware failure when it matters most. Shame on you apple for treating your customers this way. . I've had enough and I hope you lose more market share as time goes on to a more open and as far as I'm concerned, a better produce, Android.     Have you ried deleting the apps and redownload/install the apps?  You will not be charged again if you are signed into the same iTunes account that originally purchased the apps.
    Next would be to restore from backup
    Last would be to restore to factory defaults/new iPod.

    When I go to download an app, I'm told to set up with he credit card-  which is fair enough. The thing is though after I've filled it all in- it says something like "iTunes could. It process your request, try again later". This is really irritating as it's my birthday (:D) and this was a presant! Please help- I was really looking forward to using apps.  My wifi is fine, I'm posting this on my iPod.

    Close all the apps in the recents tray on your iPad, reboot again, and see if that solves either problem.
    Tap the home button once. Then tap the home button twice and the recents tray will appear at the bottom of the screen. Tap and hold down on any app icon until it begins to wiggle. Tap the minus sign in the upper left corner of the app that you want to close. Tap the home button twice.
    Reboot the iPad by holding down on the sleep and home buttons at the same time for about 10-15 seconds until the Apple Logo appears - ignore the red slider if it appears on the screen - let go of the buttons. Let the iPad start up.
    Since it will not hurt anything, you could try resetting your router as well. Unplug it from power for about 30 seconds and then plug it in again.

    This is untrue, as was stated earlier:
    I was running netflix on an itouch first generation ios 3.1.3 untill the glich with the app store.  The newest update will not run on it now and I lost the original version when I reset the Itouch thinking the problem was on my end.
    If you had said it's "incompatible" instead of "cannot handle it" or specified the version of the Netflix, perhaps the new Netflix app is so incredible, or rather it "does so much" MORE, you might be within the realm of having some useful input, but the following:

    leads me to understand you don't know what you're talking about or you're a wannabe company man and just lying.
    If anyone else has useful information regarding running the Netflix app that certainly worked for us Netflix subscribers who are also 1g owners–and there are at least thousands, if not tens of thousands–and were using the app before we upgraded to 3.1.3 or restored and downloaded the latest Netflix app, it'd be great to hear from them.  1. 2. 3.     By updating the iOS on the iPOd.  The 1G can go as high as 3.1.3.  That works with a lot of apps.  But some apps require a higher iOS and/or newer iPod.

    Connect the iPod to your conmputer and restore via iTunes. Place the iPod in Recovery mode if necessary to allow the restore.
