Generally, no. You have 2 weeks from purchase. But you have options. Www.gazelle.com will make you an offer. Sell it to them, then go buy what you want. What is the issue? Just trading for a different machine will get you only what you had in the first place.

If you have anti virus software installed, you need to disable that in order to download apps.

Which app is it ? A lot of apps which are free to download then allow you to make in-app purchases within them to unlock extra features/levels etc - if an app allows in-app purchases then it should be mentioned on its decription page in the store. If they were in-app purchases then you can turn off the ability to make them on your iPad via Settings > General > Restrictions > In-App Purchases 'off', and depending upon the iOS version on it you may also have a Require Password setting on the Restrictions screen which you can set to 'Immediately' (so your password should be asked for on every download).

You describe restoring and updating, but have you restored your iPad from Recovery Mode?
These instructions http://support.apple.com/kb/HT1808 should also include your 1st gen iPad.
If you are still unsuccessful, it might be time to buy a new one. Apple does have a donation program, but I don't think they have a trade in program for old equipment.

Itunes is charging me for a app that i never bought. how do i get my money back?
I went to buy a song on my iPod touch a couple of days ago. The song costs 1.29 but my iTunes account told me i only had 0.76 cents left. Just a month or so ago i had 46.00 dollars in my account and i had not bought anything since then. I then logged onto my iTunes account and went to my recent purchases and it told me i had bought a game a month ago for 45.00. I know i had never bought this game because i had never even heard of the game. Another thing that happened was, before my account told me i didnt have enough money in my account, it told me i put in the wrong password. Itunes made me change my password so i think my account was hacked and the person bought the game. How would i get my money back?

Can i get my money back after someone hacked into my account and bought something with it?
I got an email telling me that someone in another country used my Appstore account to purchase something. I checked my bank statement to see if this was a hoax message but it is true as I can see the same amount from the same country withdrawn from my bank account.
I changed my Apple ID password afterwards, but is there anything I can do/that Apple can do to get the money back that was stolen from me?Your best bet is to work with your bank to get them to reverse the charges by filing a fraud complaint.

A friend gifted me a copy of The Amazing Spider-man, I redeemed the code, now it tells me I can't download it onto my Ipad (1st Gen) because it does not have a gyroscope. Is there a way for my friend to get his money back, or a way for me to download it?

Check to make sure that in iTunes Preferences that Show iTunes in the Cloud purchases is check or check in the iTunes Store under Purchased to see if it rests there. If you still cannot locate them, the report the issue to the iTunes Store.

I was told you can return an app that you purchased and get your money back if that is true how do I do it?
A refund may not be possible since the terms of sale for the iTunes Store, as Joey said, state that all sales are final. You can contact the iTunes Store, explain the reason for your request, and ask, though:

It's possible they'll make an exception for you. An exception is more likely if the app is defective in some way or doesn't do what the developer advertised and the developer has been unable or unwilling to help you.

When you eneter information into iTunes Producer for uploading, the info must match what is in the internal metadata. In this case, the book is called Mississippi, but in iTunes Producer it is spelled Misssissippi. There is an extra "s". This will cause an error.
