Completely new iphone logged into someone elses apple id

So recently I got the new iphone 5s (completely sealed in plastic) as a late Christmas present but when I opened it up and tried backing up from my iCloud it asked for the password for someone elses account (I'm not sure anymore but i think it was amandamcvittie@bt???.com??). Anyway, once that came up I decided to leave it there for then and headed over to Apple's Bluewater branch, where it had been purchased, to ask what was wrong. When I got there and approached a worker I was told that there was nothing to worry about and that I should just skip the step and delete the additional account when I got into the system. Another problem was that when the iCloud had been backed up there was an error or something and it went back to the start up screen again (something I was told was unusual but nothing to worry about and which was also ignored) so I had to go through the first few steps again and yet again ignore the amandamcvittie question. Regardless, when we (we being the worker and I) finally reached the main app page of the phone we went to settings and scrolled down to the iTunes and App Store option only to find that the Apple ID was clearly mine. Having seen that we proceeded to check the iCloud option and yet again the account was clearly mine. Unable to find anything that noted the existence of any other account on my phone I was told that there was nothing to worry about and that it probably wasn't anything major. Still slightly unconvinced I went to the App Store to ascertain whether I could download apps without being asked the password for amanda's account. Having downloaded the featured 12 Days of Gifts app without any problem I decided to trust the workers and headed home.
After arriving home and connecting to my internet I pressed one of my apps to begin the downloading process of all my old data (music and apps) and was asked for my password but once I had given my password another pop up asking for amanda's password appeared. Without giving it much thought I simply pressed cancel and the downloading began. Realising what I had done I regretted not taking a screenshot since I was unaware when proof that the amanda account was still stuck in my iphone would appear again but I was not to worry as when I checked my music I saw that there was an unfamiliar album there called 'The Lumineers'. Once everything else had been downloaded this album stayed grey so I pressed it to see what would happen and if the pop up requesting amanda's account password would appear but instead of that it just began flashing and trying to download or something (it looked pretty creepy). I just checked and it is still flashing. This is a picture of the album when I click on it because I did not have the chance to screenshot anything else when it came up.
I could always upload a short clip of the album cover flashing but I can't be bothered right now
I went to the Bluewater branch again today and was told that I could exchange my phone for another one but I didn't have the original receipt with me so I have to go again.
But more importantly I just want to know why there was someone elses apple id on the phone and why there's an album there? I don't mean to jump to conclusions but doesn't this mean that I paid for a new iphone only to find that it had already been used by someone else before? Has anyone else ever had this happen before?

Just got my wife a new iphone 5s phone from Three shop and exactly the same has happened. The Apple ID was [email protected] and every time it goes to download an app it asks for their password and then my wife's password. So weird. Taking phone back to the shop tomorrow for a replacement !

    Place the iOS device in Recovery Mode and then connect to your computer and restore via iTunes. The iPod will be erased.

I only have the one Apple ID and the phone is brand new, purchased directly from Apple.
    When I check on the phone itself (iCloud and App Store settings) the Apple ID is correct. I'm not sure where else to check.
    Whilst setting up the phone, it prompted me to register, which I did. Then when connecting to my laptop through iTunes it prompted me again so I registered again. I even got a confirmation email to the email address associated with my Apple ID that the registration was successful.
    How can I add my iPhone 5s to the list of devices on the correct Apple ID?

    Thanks.  That kind of confirms.  I was able to get the phone home and restore it.  The Genius was unable to restore.  Maybe there is a connector problem? Now there is a working phone again, still with a shattered screen.  Any suggestions for what's next?

    I have done a complete restore on my iPhone 4S. 
    It is now asking me to enter the password for someone elses apple id? I cant change it back to my own Apple ID.
    I bought this iPhone as new.  No-one owed it before me.

    I only spotted this because i was doing a complete restore, to restore a backup.
    It let me skip this step in the setup (entering a password for my apple id).
    In the process of skiping this step it also flashed up 3 other apple id's before letting me go to the next stage.
    I was only doing a restore to get back some important texts i deleted.
    Think ill forget about it!
    I am able to use my phone ok now.  (just havent been able to restore my texts)

    You installed a hacked app, originally from the Mac App Store. It contains the receipt for a different app, downloaded using an account that you don't control. You need to identify and remove the hacked app.
    Important: The app you need to remove may not be the one named in the update notice.     You created a new AppleID?
    Why not simply update your old AppleID so you have only one iTunes account?

    When i plug my new iphone 4s into my pc, itunes recognises devise but when I open it it freezes itunes. Can anyone help? When I first plugged phone in, itunes automatically opened but it was a new itunes with none of my files on. But if I was to open my itunes and then plug phone in, it recognises devices but freezes.

    I changed my apple ID and it reset properly on all apps/software but the only thing it is not working with is Imessage. when i turn off imessage and turn it back on it asks me to log into my old apple ID, I have tried changing the password and adding the new apple ID but it is not working

    You logged out of your old Apple ID with iMessage at Settings > Messages > Send & Receive followed by logging in there with your new Apple ID?

    If someone else's Apple ID comes up when trying to update an app it means that that app was downloaded or purchased under that Apple ID and not yours. Apps are always associated with the ID used to download or purchase them the first time.
    To avoid this from happening in the future delete that apps purchased under the other ID and download or purchase them with your ID.

    so this is what you call
    FIND MY IPHONE ACTIVATION LOCK Find My iPhone Activation Lock - Apple Support
    when you start using iCloud on any iOS device and enable find my iPhone, this prevents  a new user from using it, and also prevents anyone from using the phone
    as it is locked to previous owners account ,this is also the case if when a phone is lost or stolen.
    the only way around this is to have the previous owner reset their apple id by going to  @ applied.apple.com
    if they are unable to do this, then the only other way around this is to have the previous owner get  a copy of their original receipt and call apple support who can then lift this lock if they get a copy of the receipt
    unfortunately there is no quick fix -> the below link explains what you should do before you sell or give away an iPhone
