Copyright laws

I have a question. My previous post was taken off because I was asking about album covers. Please explain this part of the copyright laws. If I bought the CD from a store years ago and I download certain tracks from the CD to my IPod, how and I violating the copyright law? I just want to album cover to show up on my IPod. The CD and IPod both belong to me.

Yes, I did say that friends made copies of theirs for gifts but before that I also said that I downloaded music from CDs. I was under the assumption that people would know they were my CD's. Not everyone is a crook, and I am sorry.
How can I get the album covers from MY CD's? When I populated ITunes with what I have on my computer, the covers on the little folders in the My Music folder (the bigger folder) did not move over either. Why won't that transfer over?
Some one told me that the only way to get the covers is to repurchase the music from the IStore. Also, in all seriousness (because this is going to sound really stupid), what am I not allowed to accept? I understand I can not accept what my friends copy, but what about my husbands CD's. If I use those is it OK and if it is, what about other family members? This is all new to me, this is my first IPod.

  • Am I infringing copyright laws if I sell my  iphone with itunes apps???

Hi all you iphone fans. (Im definitely one too!!)
I have a question for you.
I have been selling the iphone 1st generation on ebay for a couple of months.
Ebay have taken my listings off saying I am infringing copyright laws by selling my iphones with apps and games on them. I definitely have No music or No videos on them. Only apps and games. All are free from itunes.
Could an Apple representative please confirm if this is correct or not??
I am a reputable type person and I certainly dont want to infringe any copy right laws. The apps I have on them are the free ones installed by itunes. That is why I am contacting Apple. I really want to do the right thing. If it is against apples copyright laws, I will wipe any apps off any 2nd hand iphones I sell in future.
Any information you could help me with will be gratefully and cheerfully accepted. If Im in the wrong Im sorry and I wont do it again, but if these free apps are public domain and are free ware, can apple write to ebay or write me a letter on a letter head saying I can sell my iphones with their free apps??
As a result of all of this...my 7 year account with ebay and my feedback of 584 positives with NO negs has just been suspended and they have made me a not a registered user over all of this. Its only a temporary suspension, but its still bad good will on their part. Im guilty until proven innocent!!
Please help me do the right thing apple iphone lovers!! I will be SO grateful.
    Thanking you in advance.
    Jo-rae-me

    Snarky?
Geez - please leave or check you being so overly sensitive at the door.
This was copied from your original post in this thread.
I have been selling the iphone 1st generation on ebay for a couple of months.
Not I've been trying to sell my 1st generation iPhone on eBay so I can purchase an iPhone 3G. The way this was provided, I incorrectly read this was some profit making side venture for you.
And since Apple never sold the first generation iPhone in Australia, is it safe to assume these iPhones you are trying to sell have been hacked to be unlocked for use with any provider's SIM card? If so, this is against Apple's license agreement for the iPhone (which is illegal if Apple wanted to pursue a legal remedy), is not supported by Apple, and voids the warranty.
I just need some advice Mate.
Which you were given Mate, but you seem to have focused on one sentence only that includes the word profiting with the advice provided.
I suggest that you forget about including any free apps, which anyone that purchases an iPhone from you can download from the iTunes Store with their iTunes account (they are free after all), which if they sync the iPhone with iTunes - which 99.99% of people will do which is the only way to transfer their music to the iPhone, they will need to download the apps again - but under their iTunes account.

  • Copyright laws on using film footage to edit into trailer

Hi can anyone give me some information on what are the copyright laws for editing a full feature film so that it becomes a fan made film trailer? I have a video editing project at school and wondered if I would get into any trouble for editing a film down to lets say 3 minutes in length?
    Thank you.

I can't quote you the exact laws- U.K., or U.S.- but some general principles to keep in mind are:
    1) Copyright laws primarily exist to protect the commercial value and artistic integrity of a product.
    2) If you are using fragments of a copyrighted production for non-commercial purposes, your project may qualify as "fair use" exemption.
    3) If the distribution of your project is very limited (to your school environment for example), it strengthens the "fair use" notion, and also raises the practical question: how would the copyright holder know about it, or even care?
    4) On the other hand, if you post the project to U Tube and it becomes an international hit- and particularly if you have presented the copyrighted material in a manner that the owner considers offensive in any way- the ice starts getting a lot thinner. You may attract their attention, and they could, at a minimum insist that you remove it from distribution, or considerably worse if they wanted to pursue the matter.
Along these lines, one clever thing I see done frequently with music for video shorts published on the web: not only is screen credit given for the music, but also a link to iTunes, etc. such that a viewer can purchase the music. This is still clearly a violation of the copyright law- the gamble is that the copyright holder would be unlikely to pursue a complaint because the use, although unauthorized, effectively is an advertisement and provides the means for sales of the original work.
What you can get away with vs. what is really asking for trouble is hardly black and white, so it's always worth some research and serious thought before proceeding.

  • New Canadian Copyright Law and Apple TV

    Hello fellow Canadians,
Assuming it passes, would the new copyright law debated in parliament affect the way we can legally use our Apple TVs? On this Apple forum, Apple does not like any discussion on how to move commercial DVDs to Apple TV due to copyright infringement and this is a good policy on Apple's part.
The new copyright law has a clause regarding 'replatforming' or something like that. The example I read in the newspaper is that a song purchased on a CD can legally be moved to a personal user's iPod. This is different than the government's failed attempt at a new copyright law a few years ago. That previous version would not have allowed this kind of transfer. Perhaps that is why the law didn't pass.
If the new law passes and it it becomes legal to move a song purchased on a CD to an iPod, wouldn't it also be the case that a movie purchased on a DVD can be moved to Apple TV? If so, would that also mean we can openly discuss such topics here?
I know one caveat on the new copyright law is that you cannot bypass any copy protection. I'm not sure if the average consumer would even know if such copy protection existed on a CD or DVD they purchased.

I may step on some toes here but I think it needs to be said.
Previous versions of this law had very tight restrictions of copings files or any content which made iPods, back up disks and even a VCR illegal. The new copyright law does allow for making copies for the various devices you may own as well as for backing up digital copy protected files. It also allows for ripping cd/dvds for your own use which I do believe is still legal in the US. What it does now restrict the breaking of the digital copy protection which is found on pretty much all DVDs and purchased video files. Most music CDs and music files are not copy protected with digital copy protection and can be ripped or transcoded for personal use. Pretty much all commercial DVD's and video files have digital copy protection. These can not be legally ripped or transcoded since it will require breaking the digital copy protection.
In a nutshell yes you can legally rip a CD/DVD or transcode files but only if it has no digital copy protection.
This post will probably get deleted or I may get scolded for stating this. You will probably be OK if you rip your DVD's, just don't share them on P2P sites or sit on a street corner selling pirated copies of DVD's. Use them for your own use and don't hand off copies to all your friends.

  • Adobe Fonts used in logo design and copyright laws

Hi, if you are using an Adobe design software such as Illustrator, Flash or Fireworks to create a logo or banner for use as print and or web where it includes Adobe font in the logo and the characters create words ie; the trading name of the business do you need to approach Adobe for permission to use the fonts or is it expected considering the software is for graphical creations?

Why are we now saying that Photoshop can be used for logos? And what is wrong with CorelDraw? For someone who does not want to argue, it seems odd that an argument is happening within their own posts. :)
The ideal logo design tool offers versatile vector path editing tools and spot color swatch capability. Logo designers generally use Freehand, Illustrator, or CorelDraw... which all offer these abilities.

  • Copyright laws with itunes for video productions...

i want to sell some dvds of some slideshow/movie productions i have produced. i want, at this time, to sell them as a fundraiser for my church but would like to continue making more productions for profit.
I use my own photos for these but have used music from itunes.
how does one buy a piece of music - compensate the artist/musician - and use it for one's own production?

Double-click your Hard Drive icon to open the window. Then double-click the Library icon inside. Do the same to the Audio icon and so on.
My details in the first answer I gave are the "shorthand" way of describing this process.
GarageBand has thousands of audio loops, some only a second long and others several seconds. If you can't use it to make a proper composition you can often string together or repeat several loops which will give you a musical atmosphere for the scene in the video.
Remember that you don't need to have music playing continuously in the background. This is generally a bad technique and was popular mainly in rather poor films made 50 or more years ago. It probably stemmed from the old silent movies that needed a continuous musical (usually piano) background to set the atmosphere of a film in the absence of sound.
Also, amateurs frequently use music at full volume. If you look at a professional Hollywood type film's credits you will see a list of songs etc. as long as your arm, yet you never noticed them. This is because they are often played at an extremely low level, often bordering on the inaudible, and yet it is sufficient to give viewers the subliminal musical message.

  • Copyright question about downloaded album

Paid for and downloaded an album from iTunes store...I'm speaking at a workshop tomorrow; if I play the album in the background as background noise, is that a violation of copyright laws? Is it possible to contact the publisher or artist to get permission if it is a violation? Just want to be respectful of the artist...it's not words, just nature sounds and strings, but still not sure about what's ok and what's not...any info appreciated...

I'm speaking at a workshop tomorrow; if I play the album in the background as background noise, is that a violation of copyright laws?
Unless you or the venue has a license to play the track, or (more commonly with a venue like a hotel) a blanket license with the appropriate rights organization, yes, it would be a violation of the copyright. Any sort of public performance, whether paid or not, is protected by copyright and requires a separate license from the content owner.
Is it possible to contact the publisher or artist to get permission if it is a violation?
First I'd suggest you contact the management of the venue in which you're holding your workshop and ask if they have a performance license in place already. Many venues that commonly host such events will already have licenses in place. If they don't, then you could contact the rights-holder, but finding the correct party to speak to can be difficult, so it may be a lot easier for you to just use a track that carries no performance restrictions. There are many sites that sell royalty-free music, particularly of "generic" nature sounds and such. Search for something like "royalty free music nature sounds". If you really want that specific track, you can try contacting the record company and asking them who handles their performance rights; many labels use a clearing house.
    Regards.

  • Copyright question for posting to the web

    hi all.
i am wondering if someone wouldn't mind giving me a bit of expertise on a question i have.
i have a set of images from various sources that are basically creative imagery. i have organized these and i would like to share them by posting them to an album on my flickr account.
i have named the files with the topic and the photographer and i am wondering if it is likely to create a problem. in /most/ cases these images are actually from the New York Times so the file name says "architecture house_ray jones NYT.png" or whatever.
is there a hard rule against this? is it possible to give attribution in the photo explanation and be OK?
    thanks for any advice.

You'd have to contact the copyright holder to find out what you can do with the images.

  • Music copyright question?

I don't know if this belongs here but, alrighty! I'm new to copyright laws etc etc. So I want to be entirely sure before I do anything. Am I or am I not allowed (legally) to get PURCHASED iTunes songs from friends and put them on my computer and iPod if they authorize it, or is the purpose of authorizing computers only so that you can put your own music on more of your own computers. Also burning cds, am I allowed to or not allowed to give them to friends obviously not for profit of any sort (of PURCHASED music).

I don't know if this belongs here but ...
Generally speaking, this isn't necessarily the best place to come for legal advice.
With that disclaimer in mind, please consider the following on a "for what it's worth" basis.
Among the Terms of Service agreed to in opening an account with the Music Store are a number of Usage Rules, in particular:
(ii) You shall be authorized to use the Products only for personal, noncommercial use.
(vii) You shall be entitled to export, burn (if applicable) or copy (if applicable) Products solely for personal, noncommercial use.
    (various emphases added)
Although noncommercial, it seems to me your proposal would violate the "personal" part of the above usage rules.
Final Disclaimer: you need a real lawyer to give real legal advice; no part of this post constitutes real legal advice.

How do I dispute a copyright claim against a video i made using a trailer in iMovie? The only content I used was the video I shot of friends daughter on a merry-go-round.IMovie had the music etc that I used. Here's the message It gives a number of options to choose from if I want to dispute the claim but I don't know which one this would come under. Several obviously don't apply and of the ones left I don't know which content that is in IMovie that I use comes under. "This video is my original content and I own the rights to it" "I have a license or written permission of the property rights holder to use this material" "My use of the content meets the legal requirements for fair use of fair dealing under applicable copyright laws" or "The content is in the public domain or is not eligible for copright protection."

You want to use the "I have a license..." option, since clearly the music is not yours, but Apple has granted you a license.
For your license, see this document, section 2.M. http://images.apple.com/legal/sla/docs/iMovie.pdf
For more on this irritating problem and why it is so hard to solve, see this article. (It is a problem for Final Cut Pro users as well.)

  • Copyright a PDF form?

Am I able to copyright a PDF form built in Livecycle and offer it as part of a billing procedure my company can resell to our product vendors? What are my rights as an author of the document?

Blank forms are not in general terms protected by copyright law. Even if the form has a lot of design flourishes, it's still considered a tool to collect data.
Some elements of the form may hold copyright in and of themselves, for example:
a logotype element on the page may have protection via trademark
a graphical design element or photograph may have standalone copyright
a block of original text used on the form (by way of explanation, etc.) can be considered a copyrightable work in isolation provided it meets the standards to be considered a creative work, but plain statements of fact such as field labels or button tooltips are not.
but the form itself is not a "creative work". The same is true of things like blank diaries, bank checks or sheets of headed notepaper.

  • I-Tunes Logo for Radio Show Question  (Copyright)

    Good morning,
Does anybody know if it is persmissible to use the I-tunes Logo without violating copyright laws? I have included the logo in the background of my promotional image for my radio show since the format of my show is new music from I-tunes. I wouldnt want to go about using it and violating copyright protection laws.
Who should I contact to obtain persmission?
    Thanks,
    -Carlos

Does anybody know if it is persmissible to use the I-tunes Logo without violating copyright laws
Not without written permission from Apple, no, it's not permissible. And I would suspect that you won't be able to get such permission:
"1. Endorsement or Sponsorship: Apple does not support the use of its logos, company names, product names, or images of Apple products by other parties in marketing, promotional or advertising materials as their use may create the perception that Apple endorses or sponsors the product, service or promotion."
but you can ask. For full information and a contact to which you can submit questions (bottom of the page), see:

  • How do i copyright my photos on my iPhoto on a macbook pro i bought in 2011?

My question is how i copyright my photos in iPhoto? I bought my mackbook pro in december of 2011. I need help please.

Copyrighting photos is done by registering them with the Copyright office.  If you are asking how you flag them in iPhone that is a different story.  Just tagging them in iPhoto does not automatically make them fall under copyright laws, you need to register them for that "protection".

  • ITunes/Podcasting and Copyright Questions

I am a student at the University of Wisconsin - Eau Claire and am creating an educational podcast. I wanted to use a song I bought from iTunes recently but want to make sure if it is okay to use. My purpose is not commercial, and I only plan to use roughly 25 seconds of this song. If I cite my source (Artist, iTunes) is this all I need to do, or is there anything else just to be sure I don't infringe on any copyright laws?

You will be breaching copyright if you use this song: your podcast being free, and your only using 25 seconds, doesn't come into it (there have been court cases over brief samples). It's a breach of copyright to use any amount of any copyrighted recording without the written permission of the copyright owner, or a valid podcast licence. Though it's fairly unlikely you would get noticed, it's a risk which could leave you open to legal action for damages - someone was posting on here recently that he'd had a demand for $25,000 for unlicensed use of a song in his podcast (I don't know the outcome).
There is music available you can use - search 'podcast free music' on Google, but as regards this specific song I'm afraid is the strict answer.
