  • Plantage photoshop à cause des masques...

    Bonjour,
    Mac, 2 x 2,4 GHz Quad-Core Intel Xeon - 14 Go 1066 MHz DDR3 ECC
    OS X version 10.7.5
carte graphique : ATI Radeon HD 5770 1024 MB

Yes - although you don't really copyright your song, that happens automatically as soon as you create it. Registering copyright is what requires you to do something.
or are the loops protected by Apple copyright?
As I understand it, only to the extent that you couldn't sell them as your loops. However, you're allowed to use them in your music, in which you own the copyright.

  • Copyrights for Images in Starter Pages

Ok, I am building a web site for someone and they need it FAST, so I am using one of the starter page templates in DreamWeaver CS3. They also want a business card designed that matches the website. Can I use the header image and manipulate it to create a business card around it in Photoshop or are there copyrights on those images. If someone can point me to the terms of use for the elements that comprise the starter page templates that would be great - thanks!

Yes but not within Pages itself.
I have used iText Pro to create an inline image with link, then copied that into Pages. Sometimes it takes a little fiddling but you can retain the link. Obviously if you exported to .pdf you would lose it all.
You can always use Acrobat Pro to reinstate or add links to images or anything in a .pdf file created from Pages.

  • Adding copyright question

Is there any way to add a logo copyright instead of just the standard typed info in Lightroom or even in CS3? I'd like to add logo to batch things and am not fond of the typed copyright look in lightroom.

Not natively. You either use LR/mogrify (google for it) as an export plugin, or you use the print panel in 2.0 beta.

  • Presentation copyright question

Hello, I was wondering what others do about copyright issues
with PowerPoints that have been converted to a breeze presentation,
or what you might reccommend. It seems like a lot of our presenters
put things like dilbert cartoons, or movie clips into thier PPTs,
but I am concerned about putting them on the web using presenter
    due to copyright issues.
Any suggestions or anyone want to share experiences. I don't
want to go overboard and just axe all my speakers PowerPoints which
    use such material.
    Thanks in advance.

    Hi Uvadev:
This is a difficult area to provide any substantive guidance
    on. As
you're probably already aware, there is a lot of information
    on the
web regarding the "Fair Use" law. I found this article on the
    Nolo
Press site to be a good introduction on the topic:

If you work for a medium to large sized company, your company
    may
already have established procedures for the use of
    copyrighted
materials. If so, I would certainly recommend consulting with
    your
legal department to see what they recommend.
    Hope this helps!

  • Screenshot copyright question?

I have no idea what forum I'd ask this question, so if my question can't be answered here, please advise where to post.
I'd like to put a screenshot of a Numbers spreadsheet on my website to demo something, but I don't know if there are any copyright issues. I've searched, but can't find any Apple page that deals with it. I found one for Excel on the Microsoft website with instructions, but nothing from Apple.
If anyone can point me in the right direction, it'd be appreciated,

    Doug,
Here's what they say to do:

  • Copyright question on older VHS tapes

    Hey all,
My friend has some guitar instructional comercial VHS tapes he purchased in the 1990's. He has asked me to transfer them to DVD for him, as these tapes are not available on DVD.
These tapes have the usual warning at the begining stating:
"federal law prohibits any unauthorized reproduction, distribution or exhibition of copyrighted motion pictures and video tapes. (Title 17, United States Code, Sections 501 and 506)"
He has lawfully purchased these tapes and only wants to make DVD copies as back up for his personal use. He or anyone else will not be viewing both the original VHS tape and the DVD copy at the same time. He will not be selling them or distributing them in any way.
    My queston is:
    Is the above scenario allowed?
    Thanks,

Hey Mark - sorry for being unclear, but then, whenever you talk about copyright, there's bound to be muddy waters. :)
My position is only that if you are copying/duplicating/rearranging or otherwise using material that you did not specifically get the copyright holder's permission to use, then you need to find a legal reason to do so. Fair use is the only provision for this, and those usages are actually very clearly outlined.
What you are talking about - copying your personal copy of a specific work for private use - only holds up when the duplicate is either used exclusively or is being kept as a backup. Not written into law yet, but held up by court precedent, is the more recent usage in mp3 players, home computers, car stereos...basically, copying your songs from a legally purchased disc to multiple locations held in your own private use. Again, this is not part of the law, but legal precedent has determined that it's OK.
I wouldn't worry about what you are doing, since it is simply an attempt to maintain integrity of a licensed copy of a particular work, and the intent seems to be clear that you are going to be destroying the original (the VHS cassette).
As concerns people having rights to copyrighted material....just remember that the law is clear about your rights ending where another person's begin. When a person owns a copyright, your usage - unless otherwise stated - is only limited to the copies you have purchased. To exceed your usage according to the terms of your license agreement or other legal provisions (fair use) would infringe upon the copyright holder's legal rights....and that, of course, is where your rights will end.
And yeah, let's all remember that Steve Jobs is just like all of us....he is a regular human being, and he has opinions. When someone uses words like "should" or "I think" or "we ought to"....opinion is present, and opinion is not a good foundation for legal defense. I guarantee his lawyers just sorta twiddle their thumbs, whistling and rocking on their feet everytime Steve Jobs says something like that in public. Of course, in Steve Jobs case, if the quote is correct, he claims that we "need to have the right..." which, of course, means that we do not currently have the right.
Music on your menus....well, again, putting it on your own DVDs and watching it with your wife and kids at your house would definitely pass the courts. However, if you take it over to Grandma's house, or burn a copy for someone else in your family, you broke the law. You are then creating a public viewing or deliberately duplicating a resynchronized track for the use of a non-license-holding entity.
In all these cases, be aware that you will almost never ever ever catch the eye of the law for these uses, fair or not. Even if you did, it would cost more money to sue you than could be reclaimed. The big boys are looking to make money, and unless they thought they'd make more money in the long run by making an example of you in court, they won't bother. They are very frustrated by all of this, because we keep finding more and more fair uses and setting more precedents in our favor. I'm not now nor would I ever condone or justify the illegal use of copyrighted materials. Only stating the obvious here....you will probably never get sued for it.
If you are happy with the odds and ready to accept the risks, then make your decision. Hope some of this was helpful!

  • Copyright Question - two ipods with iTunes Music

I apologize if this was answered in an FAQ or some other obvious place. I have googled around and can't seem to find the answer.
I have just purchased my wife an iPod for Christmas, making us a two iPod household (including mine). Until this point my wife and I have shared music CDs. She would keep one for a bit in the car or at the house and after a bit I would take it and listen to it in my car, at the gym etc.
How do we do this with iTunes? If I purchase an Album on iTunes, can I listen to it for a while on my iPod and then somehow transfer it to her account for her to then listen to for a while on her iPod? Does the copyright regulations of iTunes allow for sharing music around on different iPods?
Thanks in advance for any assistance. We do try our best to stay legal on all fronts in the digital age!

Thanks for the speedy answer to a newb! So far the wife and I are LOVING our iPODs, and due to the quality of the nano Gen4 (they are SOLID) are considering our first MAC purchase (heck I have wanted to go MAC since Windows Me )
Just so I understand, if I copied the iTunes my wife purchased onto a thumb drive, then put the drive in my PC and opened itunes and did Add to Library, I could then select that drive and import them in? And I could then sync those iTunes to my iPod?
    Thanks again!!

  • Copyright Question about Adobe Patterns

I have created illustrations for a book and am using Adobe Photoshop Elements to "color in" my drawings. In addition to the patterns which came with my program, I have downloaded patterns from Adobe Exchange. How would you suggest I reference/give credit to Adobe in my publication since these patterns are under copyright protection?

Unless you sell it as your own creation (that is the pattern template/ swatches, not the result), the usage of provided content is covered in the EULA. No need to make any extra mention of specific stuff beyond perhaps a generic © Adobe for the relevant parts. For third-party content that may be different, but you should find the relevant info from the authors there...

  • Copyright question about downloaded album

Paid for and downloaded an album from iTunes store...I'm speaking at a workshop tomorrow; if I play the album in the background as background noise, is that a violation of copyright laws? Is it possible to contact the publisher or artist to get permission if it is a violation? Just want to be respectful of the artist...it's not words, just nature sounds and strings, but still not sure about what's ok and what's not...any info appreciated...

I'm speaking at a workshop tomorrow; if I play the album in the background as background noise, is that a violation of copyright laws?
Unless you or the venue has a license to play the track, or (more commonly with a venue like a hotel) a blanket license with the appropriate rights organization, yes, it would be a violation of the copyright. Any sort of public performance, whether paid or not, is protected by copyright and requires a separate license from the content owner.
Is it possible to contact the publisher or artist to get permission if it is a violation?
First I'd suggest you contact the management of the venue in which you're holding your workshop and ask if they have a performance license in place already. Many venues that commonly host such events will already have licenses in place. If they don't, then you could contact the rights-holder, but finding the correct party to speak to can be difficult, so it may be a lot easier for you to just use a track that carries no performance restrictions. There are many sites that sell royalty-free music, particularly of "generic" nature sounds and such. Search for something like "royalty free music nature sounds". If you really want that specific track, you can try contacting the record company and asking them who handles their performance rights; many labels use a clearing house.
    Regards.

  • Copyright question for posting to the web

    hi all.
i am wondering if someone wouldn't mind giving me a bit of expertise on a question i have.
i have a set of images from various sources that are basically creative imagery. i have organized these and i would like to share them by posting them to an album on my flickr account.
i have named the files with the topic and the photographer and i am wondering if it is likely to create a problem. in /most/ cases these images are actually from the New York Times so the file name says "architecture house_ray jones NYT.png" or whatever.
is there a hard rule against this? is it possible to give attribution in the photo explanation and be OK?
    thanks for any advice.

You'd have to contact the copyright holder to find out what you can do with the images.
