Do I need insurance to get a new iPhone if my lock button doesn't work?

I have an iPhone 4 and my lock button doesn't work anymore. I've asked around and some of my friends think it's a malfunction in the spring, I was wondering if I could get a new phone since it's a malfunction and that it's not my fault.

If it's within the first year's warranty or within the extended applecare warranty period it will be repaired free of charge provided the fault does not contravene the conditions of the warranty.
If it's out of warranty you can pay for an out-of-warranty repair.
Either way you should take it to either your service provider or your nearest apple store.
