Error 1004 when upgrading to ipod touch 3.0

I recently bought my ipod touch 1st gen from a friend and have tried several times to download the 3.0 update. I even restored the ipod beforehand, tried several different credit cards, changed the Mrs to Ms on the information screen... It won't work. Why would it let me restore it with my AVG antivirus on but not let me upgrade it? Is it not basically doing the same thing only back-dating and not updating?
anyway I went ahead and disabled the AVG and turned my windows firewall completely off, and then re-entered my CC info, accepted the terms, and hit Buy, to no avail. Is there any way I can download something between 1.5 and 3.0? Maybe if it was partially updated it would accept the full newest update?
ipod touch 1st generation, 16gb, now fully restored to original specs
Dell Inspiron e1505 with Vista 32bit home premium, 40 gigs of free space.
All of my music is on my removable terrabyte, but it has had no problems uploading music previously.

I turned off my firewall, turned off AVG (all previous suggestions) and NOTHING. IF I try a different computer will I be able to re-sync to this one and keep the upgrade?

I had the same problem and solved it by just signing out and back in to the iTunes store. (Open iTunes, in the menu bar at the top click Store then scroll down to Sign Out then sign back in.) If this doesn't help, read the following thread: http://discussions.apple.com/thread.jspa?threadID=2016045

    I am having some trouble trying to get IOS 3.1 on my first generation Ipod touch.  I have the latest Itunes, I do not have any dvd burning software like Anydvd that can interfere, and I've tried it on two different computers with no avail.  Any help is greatly appreciated.

    [Music files are still there, and I can play them on my computer directly from the iPod [just one track at a time] but not in the usual way, through headphones.]
    On the Summary page of iTunes for the iPod, it shows 50-plus gigabytes of "Other" content and no music, which was not previously the case.  I assume this is related to the problem.
    I can bring up individual tracks on the iPod and see cover art, but cannot play the music.

    iCloud is free, iTunes match is $25 a year.
    I had the same problem and when I went to Settings I had 0 songs, even though they were obviously still there since I only had 15GB free on my 64GB device.
    I decided to do a complete reset/restore of my 4th gen iPod Touch, Bad move! I've been messing with it for hours, and it simply won't restore--it keeps hanging on a black screen with an Apple logo and a progress bar at about 10%, sometimes it goes completely blank and tries again, with the same result.     I'm ready to bang my head against the wall! I can put the device in recovery mode, connect to iTunes on my computer, and get it back to the setup screen, but when I go through the process again and try to do an iCloud backup I get the same reset/restore loop.
    I could start from scratch, but I really, really, really don't want to go through all of my hundreds of apps, reinstall them one by one, etc. etc. etc.
    I thought that once I started using iCloud, I didn't need to sync with iTunes anymore--guess I was wrong.

    - iOS: Not responding or does not turn on
    - Also try DFU mode after try recovery mode

    - If not successful and you can't fully turn the iOS device fully off, let the battery fully drain. After charging for an least an hour try the above again.
    - Try another cable
    - Try on another computer                            
    - If still not successful that usually indicates a hardware problem and an appointment at the Genius Bar of an Apple store is in order.

    i had the same problem, error 1004 when updating apps from iPod. In case this solution doesn't work for you try this one i found in another thread
    Go to Settings -> General -> Reset -> Reset All Settings
    And confirm. This will not delete your personal data.
    After these steps I finally was able to download pending updates.
