If you do not use its syncing computer and sometimes anyway, you have to place the iPod in Recovery mode in order to restore.

I forgot the restrictions pass code for my sons iTouch. I tried using the restore function like it said in some help discussions, but that did not work. ( hooked up to the computer, did restore to factory settings, then uploaded the apps again to his iTouch). No change when I go the restrictions tab under general settings. It still asks for the pass ode which of course I can't remember.......

Unfortunately, you don't. You would have to put it into recovery mode to restore it and you can't do that without a working power button.

As far as I'm aware you're referring to the passcode. It seems that you've forgot the passcode that you've inserted, so your best bet is to connect your iPod to iTunes and have it restored back to factory settings.          The device should turn on. Note: If you see the screen pictured below, let the device
         charge for at least ten minutes to ensure that the battery has some charge, and then
         start with step 2 again.
     4. Continue holding the Home button until you see the "Connect to iTunes" screen.
         When this screen appears you can release the Home button.
     5. If necessary, open iTunes. You should see the following "recovery mode" alert:
