Connect the iPod to your computer and restore via iTunes. If iTunes asks for the passcode and you can't enter the passcode, place the iPod in recovery mode and then restore. For recovery mode:

Forgotten Restrictions Passcode Help
You will need to restore your device as New to remove a Restrictions passcode. Go through the normal process to restore your device, but when you see the options to restore as New or from a backup, be sure to choose New.

i tried one of your tips on using recovery mode but it still didnt work. nothing appeared in tunes. and when i went to itunes and clicked restore iphone it just said to me :" Go to Icloud Settings on your iphone and turn off Find My Iphone before restoring your Iphone ". Of course i cant go to settings because i dont know my password. I already know my sim card password but not the Iphone password. please help me
Since you have an iCloud account with Find My iPhone enabled, you can do a remote wipe for the iPhone with a browser on your computer per the instructions included with this link.

How do i access my photos that were saved in icloud storage from before i had to reset everything. I know the photos can still somehow be accessed because icloud showed that space was being taken up for photos straight after i had reset the device and there were no photos there on the device at the time. So any ideas on how to access these photos from icloud? Any help very much appreciated, thanks.

In your case your only solution is to restore it ( see http://support.apple.com/kb/HT1808 ) and you may need to force it into restore mode to do that. This will wipe everything off it and reset it as new, without the passcode. You can then redownload purchased content, buy unless you have a sync'd copy of your contacts and photo's they will be gone.

Unlocking iPod
You can unlock iPod in one of two ways:
* Enter the combination on iPod using the same controls you used to set the combination. If you do not enter the correct combination, the digits onscreen flash red. When you enter the combination correctly, iPod will unlock and return you to the last viewed screen.
* Connect iPod to the primary computer you use it with (the first one iPod synced with), and open iTunes. When you disconnect iPod from the computer, it will no longer be locked.
If you can't unlock iPod using either of these methods, you can restore your iPod to factory settings. Please note that this will erase all data on your iPod. Afterwards, you can add your music and data back to iPod.
If you want to change the primary computer that your iPod is associated with, do this:
1. Restore your iPod. Warning: The restore process cannot be undone. All of your songs and files will be deleted. Always make a backup of your important data.
2. Connect your iPod to the computer that you want to be the primary computer.
3. Open iTunes and synchronize. -

Then I tried to remote sweep it from find my iphone online. But my phone is offline, and it won't go online because my phone is disabled! Please help me fix this!

I have done this many times but now I am being asked for the airplay device passord.

The first way you can connect the iPod to the computer it was originally configured on, and open iTunes. When you disconnect iPod from the computer, it will no longer be locked. You then can go into the preferences and turn off the lock. If you don’t have access to the original computer or it just does not work, you can jump to the second method. The best fix for any iPod problem is the classic “restore your iPod to factory settings.” That this will erase all data on your iPod and take you back to day one, but you can just add your music and data back to iPod from iTunes. This is the true benefit of the iPod / iTunes relationship.
