Genius Bar not really much help... can you????

My mate just crossed over to Mac's from PC's. He bought a refurbished MacBook Pro from Apple Store running Leopard and he's having nothing but problems.
The main two are that on booting up a warning pops up that there is a disc inserted which can not be read and a red exclamation mark....but there's nothing in the drive. This warning pops up now and again through normal use also.
The second main problem (which I believe is more common), is that the airport connection disconnects after approx. 3 minutes and then reconnects a few minutes later. Does this continually. Very frustrating.
He's been in to to see a Genius twice and they claim it's a software issue and that the software side is his problem and they will only deal with hardware issues (is this correct?).
So they suggested a clean install which I did for him, completely erasing and partitioning the drive through disc utility giving a completely fresh OS...... but the problems still occur.
He's taking it back to the Genius, but I appreciate any ideas of what it could be. Is it just a lemon?

who ever the person working the genius bar was is definitely not one.
sounds like some one who was lazy or just didn't want to be working.
after a clean install it wont be a software issue more than likely. did you download all the software updates?
best way to go about this would be to call apple and get a case number and then go into the store with it so they cannot argue easily if they were telling you they couldnt do anything
