Getting a judgment vacated in Oregon?

Hey there, not sure if anyone can help me here. I have a judgment that I just finished paying off. The collection agency is Asset Acceptance and it's for an old Chase (I think) credit card. I'm dying to get this thing off my credit somehow, because it's not due to fall off until 2020! I looked up the laws for getting a judgment vacated in Oregon and there are all kinds of limitations. I would have to file the motion within 180 days of the entry of judgment (we're past that) and I would have to say that I was either not served (I was), that I have some excuse for not being able to appear (I don't, really) or that I object to the debt (again, I don't, really.) I called the courthouse and spoke with someone who said that usually it is the plaintiff's attorney who files a motion to vacate (because they've made a mistake or something). This makes me wonder about calling up the plaintiff's attorney and asking if they can vacate the judgment for me.  Thoughts? Is this hopeless?

    Hi, I'd appreciate any insight into my situation.  I had a Chase credit card go bad.  They sued me and won a default judgement.  Froze my bank account.  I hired an attorney who filed a claim of exemption because I was the head of family supporting 3 children on my own.  (I left an abusive marriage.  I had restraining orders and everything)  Anyway, Chase did a Voluntary Dissolution of Writ of Garnishment and that went away.  I want to file a motion to vacate the judgement.  Can I?  Do I need to go back to my attorney?

    It really varies by state and most have established deadlines for filing to vacate in a default judgment. Also, if the debt is yours, even if you are successful in getting the default judgment vacated because you weren't properly served or have a valid reason you couldn't appear, etc, Chase can refile against you. They may not be able to garnish but they can win a suit against you. In most states, judgments can be renewed collectible for years...my state allows 20 years. The other kick in the teeth is that if they renew the judgment years down the road, the CRAs are allowed to continue to report them as long as they are enforcable. I believe they can report for 7 yrs 6 months from filing if paid. If not paid, they can report beyond that if they are still enforcable in your state.
    If you can get the judgment vacated, it would be best for you to settle, pay, or set up a payment arrangement to prevent them from just getting another judgment if the debt is yours and valid and within SOL.

    So I decided at the age of 31 with a wife and a 6 year old that it is time to grow up and take control of my credit. I finally graduated college and started graduate school. I also finally have a very good job that pays quite will for the first time in my life. So the wife and I are starting to look at houses to get our son into a better school district. I decided to pull my scores and TS came in at 604 and the other two were 584 and 568. Not a huge shock because of my past negligent attitude.
    I currently have a repossession on my record that has been settled but is obviously still there and I have two paid judgements which I know hurt. Again I was never really concerned with any of that stuff but times have changed! I decided to get a secured card with Navy Federal, my mom put me as an authorized user on her Home Depot card so it is a start. Now because of this excellent forum I decided to sign up for the myfico 3B ultimate program. However, I have no idea where to begin with these scores. I get that mortgage lenders use a different score but myfico report shows a mortgage score on all three bureaus for three different FICO scores! One says the FICO 2 score and another says FICO 4 score and lastly the FICO 5 score. I have no idea where to begin but I am really dedicated to joining everyone in the 700 club!

  • WI Judgment Question - FOLLOW UP

    I have a judgment for medical bills I am currently making monthly payments on.  I live in WI.  The balance owed on the judgment is approximately $3000.  I have been making monthly payments.  They refused payments prior to filing suit - they gave me 30 days to pay in full or they would sue.  I was unable to make a payment in full, so they sued.   The judgment was granted in March.  I really want to have the judgment vacated and think I can possibly come up with the remaining balance in the next couple of months (prior to 6 months from date of judgment).  Below is the WI statute that seems to address judgments.  I deleted the portions that did not deal with my situation (improper service, etc).  I read it as if I pay the judgment off prior to 6 months (reasonable time) I can file a motion for it to be vacated.  Is that what is meant by “relieve a party….from a judgment”?I will be consulting with a local attorney, but I was just curious as to others’ interpretations and if anyone has had any luck getting judgments vacated in WI. Thanks!! 806.07  Relief from judgment or order. (1) On motion and upon such terms as are just, the court, subject to subs. (2), may relieve a party or legal representative from a judgment, order or stipulation for the following reasons: (e) The judgment has been satisfied, released or discharged;(2) The motion shall be made within a reasonable time, and, if based on sub. (1) (a) or (c), not more than one year after the judgment was entered or the order or stipulation was made.     Hello everyone, Long story short, years ago when I was in college and immediately after graduation I ran up several credit cards trying to stay afloat without having to move back in with my parents. A judgement was gotten against me by discover, which was for 3k~. I settled with them for 2k, and sent the last payment today. I got it in writing that the judgement will be "cancelled." I assume this will stay on my credit report, but will be marked as settled? I have two other accounts in collection, and they have both been sold I don't know how many times. I called them a few months ago (probably a bad idea), and offered to settle. They both wouldnt budge much, so I told them it wouldn't work and ended the call. These are the accounts I need help/advice. Information taken from Credit Karma: Calvary Portfolio ServicesOriginal Creditor Citi BankOriginal opened date: Feb 24, 2015 (this doesnt make any sense, since I quit making payments on the card in around 2012)Balance: $1,101 Portfolio Recovery AssociatesOriginal Creditor GE CAPITAL RETAILOriginal opened date: May 20, 2013 (this also doesnt make sense, but I may be mistaken)Balance $720.When I spoke to these guys they had transferred it over to a lawyer in my state.     Just so I understand, the original balance was $1,700 and you've paid $1,950 to Discover and they offered to vacate if you paid in full, but that would of been a higher amount as it included additional fees? I would try to contact Discover to let them know that you paid the $1,950 as agreed and to find out how to now get it vacated. (don't bring up the other fees). They will highly likely direct you to the attorney. If so, do the same with them. Push very hard to get the judgement vacated now that you've held up your side of  the bargain. If they won't budge but counter that if you pay more they'll vacate, get something in writing and continue making payments or get something in writing that shows the judgement has been satisifed. That might not get it vacated but it would likely sufficient for a future lender to approve you for a mortage, etc.  I'd wait to hit up those other beasts once you know how you'll proceed with this one. Then, save up the full amount and contact each one, one at a time and try to settle for less if they delete. Keep saving and going on to the next one. Yes, another one might sue you. They'll likely threaten to at the least. keep your chin up! You're being proactive. Stay on the grid and work hard and you'll be fine.

  • Manually geotagging using GPS coordinates - not location names?

    I recently came back from a vacation in Oregon where I took close to 1000 pictures. Since I knew it would be difficult to remember the exact location of every picture, I brought along a standard GPS and took a snapshot of the coordinates displayed on the screen at each location I took pictures. I probably should have tested my theory first, but I assumed I could just plug the GPS coordinates manually into iPhoto. It turns out I can only use a location name - not coordinates. Since most of my photos were taken away from civilization, they don't exactly have names.
    I don't mind doing a little manual work to make this work, but does anybody know how I can get exact GPS coordinates on my picture? I don't really want to just type "Portland Starbucks" or something and have to drag around until I'm close to where I think the picture was taken.

    iPhoto has a neat feature called "Help"

    If you have latitude and longitude information for the place where you shot your photos, you can use it to add the location to your photos and Events.
    To use latitude and longitude to add a place:
    Select the photo or Event you want to add location information to.
    Click the Information button in the lower-right corner.
    This “flips” the photo thumbnail or Event tile so that you can enter information about it on the “back.”
    NOTE:You can also select and add locations to more than one photo in an Event or other group, without adding locations to them all. To do so, select the desired photos by dragging or Command-clicking, move your pointer over the selected photos, and then click the “i” button for any one of them. Continue to step 3.
    Select “photo place” for photos or “event place” for Events, and then choose “Find on map” from the pop-up menu that appears as you type.
    The Add New Place dialog appears.
    In the search field, type the latitude and longitude, separated by a comma.

  • Mac vs PC: bus bottleneck in Mac?

    I am a long time Mac user considering an upgrade to a Mac Pro for photography and soon for video and gaming. A photographer friend familiar with both Macs and PCs told me that I should consider the PC option for resource intensive applications as Macs have a bus bandwidth limitation that PCs do not. I'm waiting for him to get back from vacation to discuss this in more depth but in the meantime thought I'd try to get some authoritative insights here. Relative to PCs, is there any bottleneck in Mac hardware?

    Most of the time, this type of comments from your friend can be chalked up to comparing older Mac technology with new PC technology. Here is an example, and one that keeps rearing its ugly head from time to to time.
    In 2006 Apple introduced the Mac Pro the first of the Intel based workstations. One of the choices Apple made was to us FB-Dimm in its memory architecture. FB (fully Buffered) memory increases both reliability and memory density, but because it requires an intermediary memory buffer between the memory and memory controller, it can have a lower top memory bandwidth then more conventional memory designs because of the increase latency caused by the memory buffer system.
    The trade off for memory reliability, automatic error correction with no system overhead was probably the right choice for a workstation class system. But boy did the PC folks love to use memory bandwidth benchmarks to show how inferior the Mac Pro was for playing games.
    Over the years, Apple has both improved the memory bandwidth, and changed to new memory architectures that provide a nice increase in memory performance. However, the old Macs are slow because of poor memory performance is still often heard, though it is no longer true, actually it was never true it was just dependent on which type of tests you want to use for your benchmarks.
    So next time someone tells you a Mac has bus bandwidth limitations, ask them for specifics. Which Mac model vs which PC model, and just what benchmarks were used and what were they testing for.

  • My phone froze on iTunes logo for a day of long download, turn out it restored to factory setting and I lost my recent travel photos. How can I retrieve?

    I was using my phone, then it prompt me about a new update. I hit the button to update, after few minutes or so my phone shuts off and came on with an iTunes logo and that's where the problem starts. I thought it was signaling for me to connect my phone to iTunes so I did. It had no options for me besides to restore my phone and I was not sure what was going on I thought it was the process. Even without that, on iTunes I couldn't do anything, no other options were available for my phone besides restore phone. So I clicked it took a whole day and kept coming back with error messages after long waits of trying to restore. I gave up and try again because I needed to use my phone and it still has the iTunes logo to plug to my computer then I tried it over night. This was a frustrating matter. By the time I woke up, my phone was back on with iTunes telling me to register as a new phone or back up to a month ago which was when last I backed up. Thie main issue am having is that I went on a trip two weeks before and had saved new contacts on my note app and also pctures that I took that were so impotant to me and now all lost, cleared, deleted, without my consent. Funny thing is, I turned off my iCloud long time ago because I didn't have space on it and I  didn't have any other syncing deviced hooked or nothing. I wish to get all my vacational memories back pleeaaaassseee. I truly wish there was a way, I will pay a reasonable amount to get it back

    I did but that was from a month before, I want pics I took after that backup time. It deleted without my consent like this is not cool. I had recent pics from my trip.

  • Mail server rejecting messages and carrying out old sieve scripts

    A week ago I upgraded to 10.6 and am now experiencing strange behaviour: occasionally, incoming messages do not make it to their recipient and the sender gets an old vacation reply that I had set up using sieve scripts in Leopard. Here is what the SMTP log reports when a message does not make it:
    "Recipient address rejected: Service is unavailable"
    I do not know how to go in and investigate what is going on with sieve scripts because it seems sieveshell has been gutted in 10.6. I currently do not have SL's new vacation message feature enabled, but it worked fine when I tested it. Any help would be greatly appreciated!

    You can remove all of the old sieve scripts...
    sudo rm -rf /usr/sieve/*
    copy/paste into terminal.

  • My external display issue is driving me nuts!

    I am ready to scream! I have a newish MBP and an external SyncMaster225bw that was working for awhile nicely. Then I upgraded to 10.5.2 including the graphics update. Then it no longer worked. Next I did an Archive and Install and it was working again but in the last week it back to not working. It used to be that I would boot up my MBP (external monitor not plugged in) and then plug in the external monitor. That was after the 10.5.2 + graphics update. Then I did the Archive and Install and I could leave the external monitor plugged in. Oh, I did not install the graphics update after doing the A&I. Now, it doesn't matter when I plug in the external monitor, it just doesn't work right! Up in the Menu Bar where the Displays icon is, it sometimes isn't called SyncMaster- sometimes it's called Display. So it's not even identified correctly. Then none of the resolution choices that I have in the window display it so that it's not distorted. I click on Detect Displays and it doesn't make any difference. I unplug it and plug it in and it doesn't make any difference. And it will change the background picture on MBP also! So then I have to find the picture I want again..... The background picture for the external monitor would sometimes display but today it is the Time Machine background. Also in the Display Preferences pane, under Arrangement, it looks like the external monitor is the smaller of the 2 and square in shape which it is not. So as you can tell there are lots of issues going on and it's giving me a headache!!! I know there are others out there with the same issue or close to mine but I just had to rant. I am very frustrated as you can tell. When I get back from vacation, I can call Apple to see if they can help me but since it's not an Apple external monitor, I am not sure how much they can/will help me..... Judy

  • Dtlogin fails after changing UID - invalid MIT-MAGIC-COOKIE

    The environment is a small stand-alone network of Suns running Solaris 5.10 with no central admin, no DNS. One of the users had login accounts on several machines and asked me to fix it up while he was away. So I consolidated his several home directories onto one machine, changed all the different UIDs on the various Suns to be the same UID, did a chown to match on all the files in his new consolidated home directory, then modified /etc/auto_home on all the machines to point to the new home.
    It all works with console or ssh logins and with dtlogin from the machine on which I didn't change the UID (also where his home now resides). But on the other machines where the UID was changed, trying to log into either CDE or JDS soon comes back to the login screen with an error in .dt/startlog: "invalid MIT-MAGIC-COOKIE-1 key", "Xlib: connection to :0.0 refused by server". I'm guessing the problem is because the user's current UID is different that what it was before on this machine.
    I tried deleting his ~/.*authority files, moving his ~/.dt directory out of the way, and even deleted and recreated the user on one of the remote machines with no joy. This user is going to be mighty unhappy with me when he gets back from vacation next week! Help.

    Thanks to these suggestions I was able to determine that the X stuff was still referring to the user's old home directory on the local machine rather than his automounted home directory.
    All the local disks were called /export/home -- in an effort to deconfuse myself and make sure I knew which disk space was being used, I changed them to /export/home-A and /export/home-B on machines A and B (renamed the directory and changed /etc/vfstab). All normal logins work, but no X logins work. When logged in as the user, xauth says "error in locking authority file /export/home/user/.Xauthority" but there are no longer any /export/home directories! This is after I've deleted his .Xauthority file. Apparently, the X stuff is remembering somewhere an old path. How can I clean this up?

    My credit is poor so a trade in is not an option since when I have spoken with several dealerships that will require between $2-4K down payment. Capital One Auto loan, $18K balance, at best the car is worth $14K and at worst $10K. Car payment is $640.94 with 23% interest rate. Oh also its a 2009 Chevy Traverse. I have not tried selling it because I would not be able to get a personal loan to pay the difference. I personally don't think it will make much difference to my credit if I voluntarily surrender the car but I need some advice before I even attempt this. Yes I would need a car but I can drive my brother's car in the meantime as he is a truck driver and is only home sporadically. And yes this is a very big drain on my finances when my car payment is way more than my house payment. My house payment is only $462. But between these two debts its becoming increasingly difficult to just maintain.

Is it possible to pick up a second job or sell things around the house to get the funds together so you can pay off the part that is upside down? That way you could either refi it to a lower rate or take it to CarMax and sell it to them.All you need is an additional income for a short while until you can sell the vehicle. I would hate for you to go through a repo and get a judgment and have to pay it and not have the vehicle.Do you know what is holding down your score? Do you have credit card accounts or just the auto loan and house mortgage?

    This is my email to Flip Video on 26 May 2008:
    My MAC Updater downloaded the new QT 7.4.5 on 5 Apr 2008. I have been making movies in iMovie, and then posting them to YouTube. In the beginning I uploaded the movies as MOV files but soon discovered AVI files (larger file and longer time to upload) had more clarity when viewed on YouTube. Once the new QT 7.4.5 downloaded all my AVI files had picture, but no sound! I downloaded the Perian component as posted in QT discussions. The sound returned to the AVI files. However, when I Exported an AVI movie from iMovie the picture quality was worse than the MOV movie. There is something wrong with the new QT 7.4.5 when working with AVI, my AVI movies look terrible. These AVI files were all downloaded from my Ultra Flip Video camera with Flip’s codec 3vix. Flip is aware of this problem and acknowledged it last Friday. Flip says Apple is aware of the problem.
    My MAC PowerPc G4 has performed well in the past two months when working with the Flip Video camera. So, at Flip Video’s suggestion I upgraded the operating system to OS 10.5 from OS 10.4.11. Flip Video says their camera works with OS 10.5. Once OS 10.5 was uploaded I soon discovered that iMovie 08 would not operate on my PowerPc G4, 1.86 MHz. The speed requirement for iMovie 08 is 1.9 GHz.
    At this point of “spinning my wheels for nearly a month” with this Flip Video camera, I decided to purchase a new iMac. On May 2, 2008, I walked out of the Apple Store in Walnut Creek with the new iMac 20-inch: 2.66GHz. Now the Flip video camera should work and all my video problems solved. However, this was not to be.
    When I attempted to Import Flip Video AVI and MOV files into iMovie 08 the files were “grayed out” and would not Import. None of my previous Flip Video files would Import. I tried making new Flip Video movies, they also would not Import into iMovie 08.
    At another Apple Store, the tech suggested I download the previous version of iMovie HD. I did this and with hours of working through the different Export options I was able to create movies to post again on youTube. However, the picture quality of the newer iMovies has never approached the quality of my last post before QT 7.4.5 downloaded. Remember my problems started with QT 7.4.5. Well, my new iMac came with QT 7.4.1, I have not Uploaded QT 7.4.5 and won’t until Flip Video fixes this problem.
    Examples of my Flip Video movies can be viewed on youTube at: sffoggydays. The last video with excellent picture quality was posted 6 Apr 2008 titled “A Day at the San Francisco Zoo, Chapter Nine, L-Taravel Ride to BART.” This video was made in iMovie and Exported before QT 7.4.5 downloaded. All the youTube Flip Videos made after 6 Apr 2008 have poor picture quality.
    It is time for Flip Video camera to stop “passing the buck” to Apple. When manufactures of operating system such as Apple and Microsoft create newer and upgraded systems, it is the responsibility of the manufactures of applications to redo their programs for operating on the new systems. Here is where Flip Video is not accepting this responsibility to Mac users of their camera. The Flip Video application/codex/drivers need to be updated in order to fix the following problems:
    - No sound on AVI files in QT 7.4.5
    - No Import of AVI and MOV files in iMovie 08
    - Poor picture quality for youTube in Export of iMovie HD
    I like my Flip Video camera, want to continue making movies for youTube, and recommending the camera to others. The Flip Video camera people need to fix these problems for Mac users.

    I also purchased the Flip Video - was thrilled to see that they worked with Apple computers. I made several movies with it when I had my PowerBook G4. I went on a great vacation & took several once in a lifetime videos. Got home & couldn't wait to put them in my iMoive -06, burn them on my iDVD and sent them to several family members & friends. Before I got the chance, I had my system updater tell me that there was a new version to QT. GREAT, I thought, just in time for my vacation videos. Like you, after the QuickTime upgrade, I got video, but no sound. I was SICK about it! I also wrote to the Flip people & got a response somewhat like yours. I left the videos on my Flip which left no room for any others, but I didn't want to take the chance of losing them. After reading from Flip that it would work with OS 10.5 system, I talked myself into getting a new MacBook Pro. Came with all the upgrades iLife -08 and the OS 10.5.2 OK...finally, after months of stressing over losing the vacation videos, I had all I needed to save them! Of course the $2,000.00 price tag hurt a bit, but I deserve a new computer.
    Well...I STILL can't get my priceless vacation videos edited and burned! I tried downloading 2 different programs that were supposed to help convert my Flip movies to something that would work, but they haven't. I could get it to work on my desktop with QT, but what good is that?? I want to make DVD's to send to others & save for my grandkids (if I ever am lucky enough to get some!)
    I'm TOTALLY disgusted & feel I've wasted my money on the Flip Camera (that at one time I loved & was seriously considering giving them as gifts) the $2,000.00 on a new computer (that even though I do deserve, didn't REALLY need one yet!) AND I still have vacation videos that I can't share!
    So... I agree! Flip should honor their word that is printed on the box & MAKE it work with all Apple computers. Surely they can find a fix!

    Oh, Flip also said they 'heard' that QuickTime Pro would work with iMovie -08 - although they haven't actually tested it themselves. NO THANKS!!! I've got WAY too much money invested in this stupid Flip camera!

  • Postscript fonts and MacBook Pro

    When I had my 1.67 Powerbook, I often used an Apple Postcript font family -- ITC Garamond. When I install it on my Intel 15" MacBook Pro, however, within a short time it causes Word to hang during any save, crashes my other apps running at the time, and then when I force quit, sometimes causes the computer to forget most of the installed fonts until I restart. Happens over and over. I had hoped that 10.4.7 might fix this issue, but it still is happening. I thought OSX was supposed to run just about any fonts, and that the Intel switch didn't affect font functionality?

    I get the same problem.
    I have access (via work) to the entire Adobe OTF library. Any of those fonts that I use on the MBP + Word 2004 Mac combo = freeze on save.
    I know the fonts are fine because fontbook authenticates them.
    Also, Pages 2 (I'm using the trial version but I will be buying once I get back from vacation) plays very nice with the OTF fonts. To the point where it can use the ligatures (automatically) that MS Word doesn't like to at all--at least the Mac version. On PC you can use ligatures by inserting them as characters which plays havoc on spellcheck (since Word thinks it is a misspelled word). Pages 2 automatically uses the proper ligatures (if you set it) and can undo it at the click of a button.
    The Word freeze + the Pages 2 ability to auto recognize when ligatures should be used (plus Pages' ability to export to Word and PDF without plugins) make it my word processing program of choice now for Mac.
    Of course I'd like a working version of Word that plays nice with the OTF fonts because Word does do a better job of autocorrecting mistakes than Pages does. Ideally I'd like to do all of my WP on Word, then import into Pages and auto-insert the ligatures.
    I have a feeling it's a bug w/ MS. Maybe the universal binary version of Office will fix it...
