My iPhine 5c is broken and will not switch in at all. It is to be repaired but the insurer says the iCloud account must be dissasociated from this phone first. How can I do this whilst not being able to access the phone?

You can't delete an account, you can only stop using it. If you're getting that error message you won't be able to create a new account on your device. Your only options are to re-use one of the accounts previously created, or create a new account on a different iOS device or Mac (running OS X Lion or higher), if you have one.

You can, but that isn't why he's getting your text messages. That's being caused by using the same Apple ID for iMessage. Have him go to Settings>Messages>Send & Receive, tap the ID, sign out, then sign back in with a different ID. To avoid getting each other's FaceTime calls, have him do the same thing in Settings>FaceTime.
Note: you can still share the same ID for other services such as your iTunes store account even though you are using different IDs for iMessage and FaceTime.
