How can you tell if an iphone is jail broken?

I believe my friends iPhone 5 has been jailbroken. Is there any way to find out if or how? I was texting them and another person asked a question from the conversation. But they were not part of the original conversation. Some how the phone is being monitored and we can't figure out how to stop it. The third person does have access to the phone so it could have been taken.

What text method are you using? If you are using iMessage, and the "third" person has your Apple ID/iCloud account name and password, they could see the text conversation form a third iOS device logged in to the iCloud account and "join" it. But this does not mean your phone is jailbroken. It just means that the thrid person had your iCloud ID/password or figured it out.

This Christmas I decided to get an iPod Touch 2G 32 gb. In shopping around and doing some comparisons, I decided I also wanted to get an iPhone. Now, like anyone, I want to get the best deal. So I have been looking around at Touches and iPhones. There are a lot of brand new touches on Ebay coming from people in India, Sri Lanka, etc. and I was keeping an eye out. I have also been looking at iPhones on ebay, because although I don't mind paying 300+ for a touch, I can't justify paying an additional 500+ for an iPhone. So, I was hoping to find a used one that someone didn't want anymore. Well, yesterday, as I was surfing the net, I came across a web site that sells all these "iPod Touch" and "iPhone"s, obviously to resellers as they are in bulk. The ads they offer are exactly the same as the ads on ebay, but in a garbled note at the bottom they say "x.ffyes, not no real.Fake" So, what I was hoping someone can tell me is how you can know an iPod Touch or iPhone is real before you buy? I am sure there are plenty of ligit people out there that just want to sell their used phone for any number of reasons. How can I weed them out from the clones and fakes? I assume you are not in USA and there are a lot of iPhones outside USA that have been unlocked unofficially and they turn into a brick if you upgrade to 2.2. If it works with 2.2 then it probably is a real unlocked iPhone.
Just pay the 500euro and buy an officially unlocked one from Apple official retailers in the countries that have that. (France, Belgium, HongKong, Australia to name a few) It's worth it.

or Redsnow - both are giveaways of jailbreak. Also a program

remove the jailbreak, this is not always successful and the remnants
left behind can cause all sorts of problems.
If iPhone is not running (needs charge, some other excuse) do
NOT buy it - you may be getting a dead iPhone or one beyond
repair.
As with any iPhone not from Apple or an Apple approved reseller,
you pay your money and you take your chances. You have to decide
if the alleged savings are worth the risk.

If it is a 3Gs from AT&T it is locked. It could have been "unofficially" unlocked (what iOS version is on it?) but if you upgrade it will relock to AT&T.
AT&T will not unlock iPhones period. Contact the seller and get your money back.
