How do you track a stalker through an old stolen iPhone not registered through iCloud or Find My iPhone?

My first iPhone was purchased by my partner, father of my child. He left us, Jan 2012. He stole it May 2012. I retrieved it. He has stalked me through that phone somehow ever since, knowledgable of all emails and texts. We couldn't prove it. He has stalked me physically and cyber-stalked ever since. I kept iPhone through court order, June 2012. Had to file civil restraining order over personal sabatoge Jan 2013. Denied by courts.
The glass cover broke June 2013. I replaced it and loaned broken glass iPhone to babysitter to take and send pics of my toddler during work hours; swearing her to privacy with baby father. She defected, giving phone to baby father.
We had trial over common law divorce and parental allocation September 2013. He admitted to mining my iPhone for texts and emails to submit as evidence to be used against me, but claims in two different statements made during the hearings he A) Had no interest in my affairs and 'threw it away' & B) "It's in California being sold as 'refurbished.'". I made further complaints of stalking and harassment. Denied, despit evidence.
He has somehow maintained knowledge of my affairs, texts and emails. In February 2014 he hacked my Facebook and made posted as me, making 'threats to himself.' Freaked, I called 911. Can do nothing, Facebook won't respond to my emails.
I replaced second violated iPhone February 2014 and he still had knowledge of my affairs, despit having wiped all phones, starting anew twice, changing all account passwords.
March 2014, I looked at my Photostream, intrigued because my NEW iPhone had hundreds of photos. HOW with a new wiped phone? THERE 43 SCREENSHOTS OF FACEBOOK NOTIFICATIONS WITH MY FIRST IPHONES WALLPAPER ON IT. Ex was still mining my affairs.
At&t spent 5 hours on the phone with me severing my current 3rd iPhone from old accounts.
Frustrated and wanting to press charges once and for all.
How do I prove/determine that he still indeed has my iPhone, has violated my privacy, falsely impersonated me on Facebook and continues to monitor my affairs?

Police won't take a report.
The judge simply rolls her eyes, even with his admittal he has phone and has used it to stalk me.
What can a lawyer do? None of my three lawyers felt there was anything they could do.
However, if Apple, as I was told by AT&T, could trace the location of the first iPhone to his physical address, I could link the offenses.

    The find my iphone app has nothong to do with it.
    That app simply allow you to find other devices using your ipod.  It has nothing to do with fining the device on which it is installed.
    If you set up the find my ipod feature that is built into your ipod and the ipod is on and it is connected to wi-fi and it has not been restored, then you may be able to get an approximate street address using icloud.
    Othrewise, it cannot be tracked.

    I am sorry you have lost your iPod.  You don't yet seem to understand that its serial number is not tracked electronically.  Here is my attempt at explaining the same thing that Limnos and stevejobsfan0123 have already told you.

    Nobody can help you with that request because iCloud and  "Find My iPod touch" do not work that way.
    If you cannot see the iPod, you cannot track its serial number.  Unless someone sees the serial number, nobody can track it.
    Regardless of whether you have properly installed and enabled "Find My iPod touch", iCloud does not track your iPod's serial number.  This is true even when you or someone else can see your iPod's serial number.
    Regardless of how much you wish iCloud could track your iPod's serial number, it cannot.
    "Find My iPod touch" can sometimes track an iPod's location but only under the specific circumstances Limnos has already explained to you. 
    If "Find My iPod touch" cannot locate your iPod by its location, there is no iCloud way to find it.  In that case, the only way to identify your missing iPod is for you or someone else to physically look at it.
    Perhaps you will be successful with one of these alternative possibilities for recovering your iPod:
      • you can physically search and find your misplaced iPod
      • someone may it returned in response to a reward that you offer
      • the police may find it after you have reported it stolen

    I want to make a script that can show replacing placeholders in the footage.
    To do so, I need coordinates of 4 corner pin of a composition(the composition which I can replace the footage).
    Of course, I can put a placeholder with dots, render the project and then motion track it.
    But it takes long time and tracked data is rusty and inaccurate.
    I thought it mightbe cool if I could just keep tracking the vertax's x coordinate and y cordinate data.
    It will be precise, clean and quick since the positions of the dots are already calculated.
    Can you help?

    Thanks for the question. After reviewing your post, it sounds like you need to deactivate Find My iPhone on a device that does not work. You will need to work with the family member of the account the iPhone is registered with. I would recommend that you use this article to help you resolve or isolate the issue.
