Hi Jasonnz,
You might want to keep the same Apple ID you used for your iPhone 4S on your new iPhone 5S. As deggie pointed out you can access the purchased made with that Apple ID on the new device.
If you are getting the "Your Apple ID is disable" it might be because you entered the wrong password many times and for security reasons Apple disables your account until proper validation. You could visit iforgot.apple.com and reset your password to make sure you can use it.

Apple will not ask you to click a link in an email. They may tell you to log in to your account to reset your password. Go to https://appleid.apple.com and log in if you ever want to change any information in your profile (or your password). And do not click the link I just posted; instead enter it into a browser.
You can verify the devices assigned to your account by going to https://icloud.com/find (again, don't click it), where you can see a list of devices registered to your Apple ID.
As a general rule, you should never click a link in an email or forum post without verifying it first. You can see where it goes without clicking it in most email programs and browsers by hovering your mouse pointer over it. On an iPhone you can check where it goes by holding your finger on the link (rather than just tapping it).

Thank you Roger, your solution gave me the courage to sign out of Systems Preferences. The pop up told me it was going to delete my contact and other information from my mac, so I was hesitant to do that. Well I did as you directed and I was able to sign in with my new apple id and I did not lose the information the pop up threatened I was going to. So again thank you. It is the little things that make a big difference sometimes.

Apps are always tied to the ID that was used to purchase them originally. Did you try entering your old password and see if that works?
If you need to sign out of your old account go to Settings>Store>Tap on your ID and sign out. Sign in with the new one.
you can also access your ID in the featured tab of the App Store. Swipe to the bottom of the screen and you will find it there as well.

You don't have to do anything with the first iPod that you don't use anymore. If you are planning on keeping it, put in a drawer in your house and forget about it.
You don't need a second account to use with the new iPod. I use one Appl e ID and iTunes library for two iPods, and two iPad. I have different content on all four devices. You can select exactly what you want to sync to each device and it can be different content on all devices.

I updated my Apple ID primary email address without having switched off 'Find my....' on all devices. A 2 hour very helpful call with Apple Support solved ny Apple ID and ICloud. Later, I tried to update apps but my iTunes account is still on the old ID and I can't access that email/password anymore. I can't get a support appointment for 48 hours but need to update travel apps soon!

For some reason, when I try to change my Apple ID back to my old email address, I get the message that that Apple ID is already in use and so I cannot use it! My iTunes appleID is an old defunct e-mail address - it does not have to be functional.
Do what Winston says to ensure you keep getting correspondence related to that ID.

I can only imagine it is because I have had to change my apple ID as I no longer use the old email address (old company). I am disappointed that this has been the result though. It doesn't matter that your Apple ID, which uses the same characters as your old email address, now has a defunct address. You need to go into your Apple ID profile and change the defunct address for a valid one. This will not necessarily change the "address" which stands as your Apple ID.
By "changing" the address directly on the Apple ID itself and not on the profile, you inavertedly created a new Apple ID.

Go to Settings > iCloud > Delete Account, and enter your Apple ID password. Then sign in with the new ID.
NOTE: "Delete Account" just means it will be deleted from the iPad. The account itself will not be deleted.

If the old ID is an earlier version of your current ID, temporarily recreate the old ID by going to https://appleid.apple.com, click Manage my Apple ID and sign in with your current iCloud ID. Click edit next to the primary email account, change it back to your old email address and save the change. Then edit the name of the account to change it back to your old email address. You can now use your current password to turn off Find My iPhone, even though it prompts you for the password for your old account ID. Then save any photo stream photos that you wish to keep to your camera roll. When finished go to Settings>iCloud, tap Delete Account and choose Delete from My iPhone when prompted (your iCloud data will still be in iCloud). Next, go back to https://appleid.apple.com and change your primary email address and iCloud ID name back to the way it was. Now you can go to Settings>iCloud and sign in with your current iCloud ID and password.

If you updated your existing account then try logging out of it on the iPhone by tapping on the id in Settings > iTunes & App Stores and then log back in and see if that 'refreshes' the account on the iPhone. If you created a new account then any content that you purchased/downloaded via the old account will remain tied to that old account, and only that old account can download updates to its apps.
