i just got a pre-used iphone 5S. It has a disabled icloud account. i tried to delete it but it asks me about the password.
i cant reset the account cause i don't know the email for verification.
also i can't restore using itunes because it asks to turn off find my iphone feature. and i can't turn it off because the account is disabled
how can I restore the iphone in this case?

You can't. There isn't a way to bypass Activation Lock: http://support.apple.com/kb/PH13695 Your only option is to return the phone if possible. If not, you have a useless device.

another account, just sign out and then sign back in with your daughter's
ID.
If you mean the iPhone will not allow any access because it is locked to someone else's
ID, that is a security feature of iOS 7. You must have the other person remove

Make sure you are signed into iMessage and FaceTime with your current ID. If they are signed into the old ID, go to Settings>Messages>Send & Receive and Settings>FaceTime, tap the ID, sign out, then sign back in with your current ID.
Then temporarily recreate the old ID by going to https://appleid.apple.com, click Manage my Apple ID and sign in with your current iCloud ID. Click edit next to the primary email account, change it back to your old email address and save the change. (You should not have to verify the old email account so it doesn’t matter if you no longer have access to it.) Now go to Settings>iCloud, turn off Find My iPad and enter your current password when prompted (even though it prompts you for the password for your old ID). Then save any photo stream photos that you wish to keep to your camera roll (unless using iCloud Photo Library). When finished go to Settings>iCloud, tap Sign Out and choose Delete from My iPad when prompted (your iCloud data will still be in iCloud). Next, go back to https://appleid.apple.com and change your primary email address back to the way it was. Now you can go to Settings>iCloud and sign back in with your current iCloud ID and password (your data will download back to your device).

I bought a i phone 4s and i am trying to set it up. Forgive me if these are obvious questions - i am new to all this. I have a apple ID/password which i have created, however my current itunes account/icloud account are set up/picking up my old email address which i no longer have access to and dont know the password. i have tried to delete the icloud account but it says i need a password. I have tried the forgot password option on apple to which it doesnt recognise my birthday as being the same as their records for some reason, and i cant access the reset email as i dont have this address anymore.

you can´t delete an icloud account without using the password.
if you can confirm that your iphone is not locked to icloud device activation with this AppleID your are not aware and you have no access for - you can attempt to "erase all settings and content" on your iphone, to remove the icloud account from your iphone. all your data will be erased and iphone is set to factory settings

You have to go to Settings>iCloud and tap Delete Account, then sign back in with your updated credentials. This deletes the account and your synced data from your device, but not from iCloud. Having the email address is not necessary. It is just the username for the device. All you need is that Apple ID and password. Now, if you forgotten the password, then you have more work to do. Since that email is no longer active, you would need to send the reset to your rescue email, if you remember that. Or you will need to contact Apple Security for help. But I cannot even log out of my icloud account due to it asking for a password, which I cannot remember and my iphone 4 needs backing up. I chose the icloud backup option and as I cannot log into icloud I cannot back up my iphone
