You don't. If it's your account, you can reset the password at https://iforgot.apple.com
If it's locked with someone else's account, the owner of the account will have to release the lock.

I have just bought an iPad that was advertised as new however when I went to set this up, the previous owner had already set up an iCloud account. How would I delete this? everytime i try to delete account it asks for a password for 'find my iphone to be turned off' which i obviously don't have.

You can't actually delete an account but you can log out and create a new one. You'd do that from the iCloud system preference panel.

Many people are having probalems with this right now. The only solution I've seen that seems to consistently work is the one posted by Brackers28 here: https://discussions.apple.com/message/23020591#23020591. This only works if you still have access to your old email account. If you don't, you'll have to have Apple help you reset the password for your old account so you can turn off Find My iPhone and sign into your account with your correct ID.

You can't.
Return the phone to whoever you bought it from and get a refund. Without the previous owners password you will not be able to enter your own iCloud acount, and when you update the phone, you won't be able to re-activate it as it will be locked to the previous owners account.
You should've checked the phone was not locked to someone else's iCloud account BEFORE buying it.

Click edit next to the primary email account, change it back to your old email address and save the change. Then edit the name of the account to change it back to your old email address. You can now use your current password to turn off Find My iPad on your device, even though it prompts you for the password for your old account ID. Then save any photo stream photos that you wish to keep to your camera roll. Then go to Settings>iCloud, tap Delete Account and choose Delete from My iDevice when prompted (your iCloud data will still be in iCloud). Next, go back to https://appleid.apple.com and change your primary email address and iCloud ID name back to the way it was. Now you can go to Settings>iCloud and sign in with your current iCloud ID and password.

If yu changed the email address of your iCloud account befor you signed out of iCloud on your device, then please
follow these steps in order to get it working properly again.
Please change your Apple ID back to your old email address (that you used as Apple ID before) here: http://appleid.apple.com
Then go to all your devices - iPhones, iPads, Mac etc. - ("Settings > iCloud") and delete your iCloud account from this devices (+ turn off Find My iPhone, but I guess it will ask you that anyway)
After that go back to http://appleid.apple.com sign in again, and now change your Apple ID again to your new email address.
Finally, set up your iCloud account on all your devices again.
Now, everything should working properly again.

Sorry, but there is no way to get around the Activation Lock without signing off the iCloud account that is signed onto the device. Have the person who sold you the device go to Manage your Apple ID and answer their security questions so they can reset their password:

If they can't remember their Security Question answers, they can contact iTunes Support to have them reset:
