How to tell if new MacBook Air is a lemon?

I purchased a MacBook air two weeks ago and have been noticing problems with it since then. I'd like to list them below and solicit your feedback as to whether this is pointing to a larger problem I should seek Apple Care help for, or if this may be something others are experienced and will possibly addressed by a firmware update.
Computer details:
MacBook Air 13"
1.7 ghz intel core processor
4 GB memory
purchased October 2011
Running OS 10.7.2
The first sign something was wrong was the battery life. I charged the computer, unplugged it, and the estimated battery time was 3:30 minutes (approximately). From the first charge.
The second sign something was wrong was when I shut the computer down with 52% battery remaining. The next morning when I started the computer it was dead. The computer will not start without being plugged in as the battery is consistently drained if it's put to sleep or shut down when not connected to a power source.
Third sign - the computer does not seem to turn off. This could be why the battery drained as mentioned above. When I have come back to use the computer an hour or so after I've shut it down (plugged in or in battery mode) the screen is gray and the shut down circle is still processing. This is a consistent issue.
I force shut the computer down by holding the power key, but when I start it the next day the computer flashes awake and asks me if I really want to shut down the computer, as if the force shut down had not even occured. The battery is not fully charged at this point (despite being consistently connected to a power source).
I think that is all. What does this sound like to you guys? This is my 6th mac laptop (first in 1995) so I'm used to different problems over the years, but this is my first time with issues like this one, and my first MacBook Air.
Finally, I brought the computer from the US to a European country, so cannot go back to the store where I purchased it to ask these questions in person. I'd have to switch my account to Apple Europe I guess. I hope that's possible.

See if you can narrow the problem through a process of elimination. First, run a Hardware Test to ascertain if the MBA has any issues that may be the cause or contributory to tthe problem.
To run Apple Hardware Test from Lion Internet Recovery on a MacBook Air (Mid 2011)
Beginning with the MacBook Air (Mid 2011) you can remotely start up your computer from an Internet-based Apple Hardware Test. These steps require a DHCP Internet connection, either wired (using the USB to Ethernet adapter, sold separately) or wireless:
Press and hold the Command and D keys while the computer starts up.
Release the keys when the Apple logo appears.
If you are using a Wi-Fi connection, select a wireless network from the menu that appears.
Follow the onscreen instructions to test built-in hardware.
If Apple Hardware Test detects an issue, it displays an error code. Make a note of the code before pursuing support options. If Apple Hardware Test doesn't detect a hardware issue, the issue may be software related.
If the system passes the Hardware Test, then move to software. You may want to consider a fresh format and re-install. You cam always cone the existing installation to an external disk and/or make a Time Machine backup, to restore your MBA's existing image, whichever way the re-installation proves to anarrow the cause.
If the fresh install still exhibits the problem, you should proceed with a warranty resolution to the problem. Then use the clone image afterwards to restore your system. If the problems disappear, then you know the prior installation had some fault. You may want to migrate the apps and data from the TM install and see if that works, or choose to reinstall your apps and just pull the pertainent data off the backups.

    You can direct connect your MBA to the LaCie via USB 2 cable.  If you have an Apple Airport Router you can USB connect the LaCie drive to the router and then use Airport Utility to configure it.  Time Machine can access it either way.

    As long as you are using the same Apple ID used on iTunes on the PC, you won't lose any content.
    You will need to authorize the new MB Air.
    Launch iTunes. From the iTunes menu bar click Store > Authorize this Computer

    It's 64-bit. All the current Macs are 64-bit and have been since 2006. Yosemite is a fully 64-bit OS.

    Some websites require a special client certficate for access. If you don't have that certficate, you'll have to contact the site operator to find out how to get one.
    Sometimes the problem is caused by a web server that is configured to request an optional client certificate. Safari treats the request as mandatory. In that case, other browsers such as Firefox and Chrome may be able to connect to the site, because they ignore the request.
    The first time you were prompted for a certificate, you may have clicked through a dialog that requested access to the Apple certificate in your keychain that is used to secure the iMessage service. In that case, you may be able to regain access to the site in Safari by doing as follows.

    Make sure the drive is formatted Mac OS Extended (Journaled)
    1. Quit iPhoto
    2. Copy the iPhoto Library from your Pictures Folder to the External Disk.
    3. Hold down the option (or alt) key while launching iPhoto. From the resulting menu select 'Choose Library' and navigate to the new location. From that point on this will be the default location of your library.
    4. Test the library and when you're sure all is well, trash the one on your internal HD to free up space.

    Since this is the second computer you've had this problem with, I recommend you look for answers on the iPhone forum. My thinking is it is an iPhone issue rather than a computer issue (unless it is some software incompatibility).

    Is the music you want on your new Mac all purchased music via iTunes?
    If so, then you can log into the iTunes Store on your Mac, and then on the right side, click on Purchased under Quick Links. Then click on All Songs, and Not on This Computer. You will see all of your purchased iTunes music listed with a little cloud next to each song. You can download songs individually, or go to the bottom and click on Download All.

    Once your in iTunes click the dropdown menu below the play button if one option is home sharing click home sharing and sign in with your apple id if you don't have home sharing follow these steps:
    1) Go to iTunes
    2) Click file (which is on the menu bar)
    3) Hover your mouse over the place where it says home sharing
    4) If you hover your mouse over home sharing you should see it says turn on home sharing click it
    5) Now sign in with your apple id
    Now have enabled home sharing on your mac.
