My daughter has an old iphone4 that she can not remember the passcode to get into it and retrieve information for her iphone5...how can I restore the phone or get the password off w/o knowing current passcode?

There is no way to retrieve any data from the phone unless you can remember the passcode. That's the whole point of the passcode, to protect the data. To remove the passcode, you'll have to force the phone into recovery mode, as described here, & restore it:

All data on the phone will be erased.

    iPhone do not get virus unless your iPhone is hacked/jailbroken.
    All 3rd parties apps run in a secured sandbox.
    iPhone battery if you haven't replaced it, is a few years old.
    You may need to re-calibrate the battery indicator.
    Charge to full using wall power adapter, play some graphic intensive game or similar till it switches off by itself, then charge it to full again.

    You are allowed two activated installations at any time. If you aren't going to be using the old computer anymore, go to Help>Sign Out in the editor to deactivate it.
    For the new computer, the simplest way is to download the trial and enter your serial number into that when installing.

    You can not access the backup directly.
    Did you restore your replacement from this backup?
    If so then you already have everything in the backup on your device.
    If not, you can wipe the device and restore from this backup:
    Settings > General > Reset > Erase All Content & Settings
    What is it you are worried about losing that isn't already on your current device?

    Unless you left the iPhone in the possession of another person it could not be hacked...and unless it has been jailbroken it cannot get a virus.
    An email account can be hacked at the service provider's end...this has happened a number of times with gmail. 
    Do a reboot, hold both the power and home buttons until the apple logo appears and it restarts, ignoring the red slider if that appears.
    If that does not help the battery situation, make a backup of your content and then restore to factory condition, Settings > General > Reset > Erase All Content and Settings, and then restore from the backup you just made.
    Contact your email service provider and let them know you are getting material that could mean they have been hacked.

    I am guessing you are talking about an encryption password that you placed on the backup you put into iTunes on your computer.
    If so, you elected to encrypt your iPhone's backup.  You will need to recall that password, or you cannot access the backup.

    You don't.  Nothing gets stored on the iPhone about what computers the device has been backed up to.

    Yes, it's called a passcode lock.
    - If it has been backed up to another computer is there anything that can be done.
    No.  You might consider changing your Apple ID password to be on the safe side, though, as well as your security questions.

    You can't.  All you can do is change the password to deny future access.
