First you need to research all the problems people are having with the higher OSX versions, & make sure you have a bootable clone of what you have just in case.
then you must get 10.6 if they still have it, install it & update to 10.6.8 so you have the App Store to buy & download the huge 10.8 Installer.

    I have the exact same issue, and no Profiles for me under System. My system was upgraded from 10.6 as soon as Lion came out and I've never had the icon.
    I have had iCloud set up by creating an account within Mail, Contacts & Calendars - but in this setup my Mobile Documents folder, my iCloud "Documents and Data", never synchronized with my other devices. That is why I began wondering why I don't have the iCon as I have seen other Macs that came with 10.7 installed factory.

    OS X 10.8 Mountain Lion is the current OS X and can be downloaded from the App store, which you can use after upgrading to OS X 10.6.
    You may know that either Lion or Mountain Lion no longer run any PowerPC code. OS X 10.6 Snow Leopard is the last operating system that can run PowerPC code. People with Microsoft Office 2004 were surprised when it would no longer run under OS X 10.7 Lion. Newer versions of Office are OK. I have a dual boot iMac, with both OS X 10.6 Snow Leopard and OS X 10.7 Lion, as I have a few PowerPC programs I use now and then.
    As mentioned above, consider upgrading your memory to 4GB for performance purposes if you upgrade.

    The version on the App Store for Mavericks is 10.9.1 and it's the full installer.
    The only time you would need 10.9 is if you were installing the delta download of 10.9.1  from Apple's Software Update Support page.
    So, just go to the App Store and you will be able to download/install Mavericks 10.9.1 without the need of 10.9.

    PSC 1315 no longer supported for scanning since Mac OS X v10.5 or while using any newer OS, there is no scan software provided by either HP or Apple (Image Capture)

    You will need to get a 10.6 Snow Leopard retail disk which I don't think are still available from Apple.
    Google "buy mac 10.6 snow leopard" to get an idea of current pricing. You'll need updates to10.6.8  in order to upgrade to 10.7 (the early core duo MBPros can not do this) or possibly 10.8 but check the exclusion list to be sure.

    When the update fails what if any error report do you get, specifically? Please do this before trying again:
    Repair the Hard Drive and Permissions
    Boot from your Snow Leopard Installer disc. After the installer loads select your language and click on the Continue button. When the menu bar appears select Disk Utility from the Utilities menu. After DU loads select your hard drive entry (mfgr.'s ID and drive size) from the the left side list.  In the DU status area you will see an entry for the S.M.A.R.T. status of the hard drive.  If it does not say "Verified" then the hard drive is failing or failed. (SMART status is not reported on external Firewire or USB drives.) If the drive is "Verified" then select your OS X volume from the list on the left (sub-entry below the drive entry,) click on the First Aid tab, then click on the Repair Disk button. If DU reports any errors that have been fixed, then re-run Repair Disk until no errors are reported. If no errors are reported click on the Repair Permissions button. Wait until the operation completes, then quit DU and return to the installer.
    If DU reports errors it cannot fix, then you will need Disk Warrior and/or Tech Tool Pro to repair the drive. If you don't have either of them or if neither of them can fix the drive, then you will need to reformat the drive and reinstall OS X.
