If you've contacted the iTunes Store and they told you that you're not eligible for a refund, then you're not. The terms of use for the iTunes Store state that all sales are final, so a refund is on a case-by-case exception basis and if they've determined that you don't qualify, then you don't. Sorry, but there's nothing further you can do.

Unfortunately when you have two phones on one account it is not possible to have two separate bills.
Your bill should show the charges for both phones separately. Your can check which phones bill you are reading by looking at the top right of the page where it says 'For phone number:'

if this is a first generation Nano i.e Black or White, you may find Apple will replace it free of charge as there is a fault with some of the batteries, they contacted me by email. i gave them the serial number on the back of the device to confirm it was eligable, and they are sending a replacement. Doesn't answer your question, but could entitle you to a free nano !!! good luck
