what if the set up assistant doesn't appear? How do I get my icloud back up on my new phone?

As wjosten said, go to Settings>General>reset>Erase All Content & Settings, which will erase the phone.  You will then go through the setup assistant as you did when it was new.  During this you will be given the option to select this option to restore from an iCloud backup, as shown in this image:

    You actually have to go through extra steps of setting up your phone as new, updating and then erasing and restoring from that back up.

    As stated in the System Requirements, an iPhone 5 runs iOS 6. In order to sync to a computer you must have OSX 10.6.8 or later and iTunes 11 on the computer. If you can upgrade your MacBook to OSX 10.6.8 (Snow Leopard) you can purchase this version of OSX in the Apple Store. Most intel macs can run at least OSX 10.6.8. If your MacBook is a power pc Mac you are at the end of the supported operating systems and will not be able to upgrade the OSX or sync your iPhone 5.

    You can't merge the backups, you'll have to delete the backup of your old phone.  If it says it's currently in use when you try, that will normally clear up on its own but may take 3-5 days to do so.  Give it a few days and try deleting the old backup again.
    In the meantime, you can create a manual backup of your new phone on your computer by connecting it to your computer, opening iTunes, clicking on the name of your phone in iTuens, going to the Summary tab of your iTunes sync settings and clicking Back Up Now.  Also go to File>Devices>Transfer Purchases.  Then you'll be safe until you can start backup up to iCloud again.

    This is not very iTunes Public Site Manager related... but I was in the same situation as you a little while ago.
    1 - Sync/back up your old 3gs.
    2 - Activatie your new phone when connected to itunes via cable and it will ask you if you want to restore our old phone.
    3 - ???
    4 - profitt!
    might also work with icloud but i have not tried that method.

    If you have a backup of your old phone, the backup should include your camera roll photos.  Restoring the backup should recover them.  This explains how to restore an iCloud backup: iCloud: Restore your iOS device from iCloud.

The pictures have been stuck on number  215 for an hour now. I've turned the phone off and on several times, but it won't progress in downloading the pictures. This happened the last time the phone was replaced and there was something I could do to get things moving, but I don't remember what?

    Then you'll have to decide when you think it's hung and unlikely to restart.  At that point, you'll probably have to reset it (by holding the power and home buttons at the same time until you see the Apple logo, then release) and try restoring the backup again.
    The only "solution" I've seen posted on photos that fail to restore from a backup that seems to have worked for others, is the on posted by ezjules here: https://discussions.apple.com/message/19518589#19518589.  If you restore the backup again, you could give it a try and see if it works for you.

    I forgot to click Restore from iCloud Backup on new Device, and then signed in on the Cloud with the same Apple ID I used to create the Cloud on my old iPhone.  Can i still access my CLoud backup for apps, photos, etc.?

    You'll have to start over by going to Settings>General>Reset and tapping Erase All Content and Settings.  Then go back through the setup screens again and this time choose Restore from iCloud backup (see image below).  Note: your iCloud account and iCloud data will still be in your account and will be synced back to your device when you sign back in.  You also may want to connect your device to your charger as restoring from backup can take some time to complete.

    OP you need to be more specific.  ARE you saying that they did not restore from your icloud backup? Or are you saying that they didn't show up under your photostream?
    If its the 2nd one, because photos are only available to other devices in your photostream for 30 days. Beyond that, they only show on the original device.  To get around this, you can, on the original device, share them all to a shared photostream, inviting only yourself to share the photostream and them you'll be able to access them on the new device.  Fair warning, sharing them to the shared photostream can take some time so don't delete them till they all show up.

    The backup for your iPhone that is created and maintained by iTunes, stores all your iPhone settings, SMS messages, recent calls, call favorites, notes created with the Notes application, alarms, cities tracked with the weather widget, stocks tracked with the stocks widget, Maps bookmarks, youtube bookmarks, etc., and photos captured by your iPhone - but I wouldn't depend on this one. Photos captured by your iPhone should be imported to your computer as with any other digital camera. Basically the backup stores all data not included with the iTunes sync process.
    If you Restore as a new iPhone, or not from your iPhone's backup, you lose all settings, and all other data stored with the backup.
    Your iPhone's backup is updated if needed as part of the sync process - the very first step during the sync process. If you want or need to restore your iPhone, and you want to do this from your iPhone's backup, you should sync immediately before restoring to update your iPhone's backup if needed.
