tried to help me out a little more than they did, its not my fault verizon told me my phone was uneder waranty and the apple said it was expired two days prior and people wonder why i get mad all the time both,my experince in both store was really ******!!!!

If you're still in warranty, go back to Apple and show proof (print off that page confirming your warranty is intact the day you go).
You may just need to perform a simple Restore in iTunes.

    (2001, 2002, 2005, 2006, 2009, and so on) If you experience this issue on a Mac, disconnect third-party devices, hubs, spare cables, displays, reset the SMC, and then try to restore. Learn how to reset the SMC. If you are using a Windows computer, remove all USB devices and spare cables other than your keyboard, mouse, and the device, restart the computer, and try to restore. If that does not resolve, try the USB issue-resolution steps and articles listed for Error 1604 above. If the issue continues, it may be related to conflicting security software.
    So I would try an SMC reset if you are on a Mac. But mainly, try a different USB cable if you have one.

    No. You have to restore. To allow the restore try the following:
    - A reset.
    Reset iPod touch: Hold down the On/Off button and the Home button at the same time for at
    least ten seconds, until the Apple logo appears.
    - Manually placing the iPod in Recovery Mode
    - Placing the iPod in DFU mode.

    - If you can't turn the iPod off, let the battery fully drain. After charging for at least an hour try the above again.
    - Try on another computer.
    - Make an appointment at the Genius Bar of an Apple store.

    If you want to start the Restore Process over then follow these simple steps. Restart computer. Open iTunes on computer. Connect iPhone to computer with USB Cable. Hold both home and power buttons until iTunes recognizes iPhone in Recovery Mode. Usually takes about 20 seconds of holding both buttons. Click Restore button of iTunes.

    After you perform each step, try to restore your device.
    Restart your computer.
    Disconnect all your USB devices from your computer and connect to another USB port.
    Use a different USB cable.
    Uninstall third-party security software.
    Try restoring using an alternate computer.
