The previous owner doesn't need to give you their credentials. They can release the device via Find My iPhone on iCloud.com as per the instructions in the link I posted in my initial response: Find My iPhone Activation Lock: Removing a device from a previous owner
If the previous owner is not present
Make sure the device is powered on and connected to a Wi-Fi or cellular network. Then contact the previous owner and ask them to follow these steps to remove the device from their account:
Sign in to their iCloud account at www.icloud.com/find.
Click All Devices to open a list of devices linked to their account, then select the device to be removed.
Click the Erase button to erase all content and settings from the device. When prompted, don't enter a phone number or message. Click Next until the device is erased.
When the erase is complete, click "Remove from Account" to remove the device from the account.
After the device is erased and removed from the account, you can proceed with the device setup process.
If the person you bought it from refuses to do this, I would assume the device is stolen and I would demand a refund and/or contact the authorities. -

Ipad needs resetting but because it's second hand the password from the previous owner is still on it and I do not know it, is there anyway around this so I can take all the data off? It's urgent because it is being used as a gift next week!
The previous owner should have reset it back to factory defaults before selling it. What iOS version is the iPad on (Settings > General > About > Version), and has the previous owner left him/herself logged in in Settings > iCloud with Find My iPad enabled on that screen ? If it's on iOS 7 and Find My iPad is enabled then you should contact the previous owner and ask them to remove the iPad from their account, otherwise you or the recipient of the gift will have problems with activation lock : http://support.apple.com/kb/TS4515

password that of course i dont know and i have no way to contact them i bought this phone at a flea market the past weekend .Can i do this myself or do i take it to a apple store?I'm afraid that if the previous owner has locked the phone, only he can unlock it, either by giving you the ID and password or by removing it from his list of devices (which he should have done before selling it on).
As you cannot contact him, you will be unable to use the phone. There is no way round this - taking to Apple won't help. Your only option is to take it back to where you bought it and try to get them to refund your money, as they have sold you a useless device. -

I have the same problem - it is maddening. I rely on this iPad for work so this is not just an annoyance! The above solutions of changing the appleid on the device or on the website do not work.
The old email address no longer exists - I haven't used it in a year probably and I no longer have the account. I logged into the appleid website and there is no trace of the old email address so there is nothing that can be deleted or changed there. On the iPad there is no trace of the old email address so nothing can be deleted there either. I have updated the iPad software and the same problem comes right back. Every 2 seconds I am asked to log in using the old non-existent email. The device is currently useless.
The only recent change to anything was the addition of an Apple TV device, which was set up using the correct login and password.
Does anyone have any ideas? The iPad has been backed up to the iCloud so presumably it now won't recognize the current iCloud account? So restoring may notbe an option? -

The Help page you came here from gives you all the information; without the previous owner's password or his removing the phone from his list of devices you cannot proceed and I'm afraid your phone is useless.

To change the iCloud ID on your devices you have to go to Settings>iCloud, tap Delete Account, provide the password for the old ID when prompted (if using iOS 7), then sign back in with your current ID.

With the transition from mobile me to iCloud, one of my email alias requires me to input a password in Mac mail. I cannot remember the pass thus am not receiving email sent to my alias.
