If the previous owner had the device logged into icloud and had the Find My iPhone service turned on, then you will have to get the ID and password from him/her in order to activate the device. If not, there's nothing you can do to fix the situation.

I'm afraid so. The vendor should have restored it to factory condition before selling it, so basically he has sold you an unusable device. If you have no way of contacting him for a refund or to unlock it you are, as you say, stuck.

If unable to contact previous owner of the iphone 5s to get them to remove there cloud password what is my option? Do I have one or is the phone I purchased rendered useless.

Unfortunately, you cannot do very much with your phone unless you get assistance from the previous owner, they should either provide you with the password to unlock it or remove their account from the phone entirely remotely through iCloud.com > Find My Phone. Take it back and get a refund.

You are experiencing Activation Lock. If the previous owner will not remove the device from their account there is nothing you can do unless the place you purchased it from will give you a refund.

here in the philippines, buying second hand products is a common practice as we are not as economically endowed like the united states. so if we're lucky to earn enough, outside of our regular expenses, we too would like to enjoy the fascinating technology of apple. hence, 2nd hand phones. but what do we do with this icloud lock? does it mean that the money set aside from our measly income is for naught?

I have an iPad which I purchased second hand late 2013. I no longer have their contact details.
On my return from holiday I plugged my iPad into my MAC and it said it was going to carry out a iOS upgrade. It started this and then about half way through said it had encountered a problem. A message then came up stating that I would have to Restore my iPad. I clicked on the Restore and it carried on.
Then my iPad restarted and asked for the sign in details that were given at its registration.
I don't have these and there is no where on the Apple site which tells you what can be done if you do not have a previous owners contact details etc.
Getting really, annoyed and upset now.

Thanks Niel. I had a feeling that would be the case. Luckily my husband had the brainwave of looking at my PayPal account as there is an email address for the guy.
I've just emailed him with the link of what is to be done. Hopefully the address is still valid and he will be nice enough to help.

From the massage it appears that your Apple ID/iTunes account is associated with the USA. It is associated by the address and the payment method. For a credit card the billing address is what is used. Also, yo can only use a Gift Card in the country's store in which the card was purchased.. For example. A card purchased in the USA can't be used in the Canadian store.

The Apple ID and Password that was Originally used to Activate the iDevice is required
If you do not have that information you will not be able to use the Device.

Unfortunately not.
If you are able to contact the owner of the Apple ID, ask them to follow these steps to remove the device from their account:
Sign in to their iCloud account at www.icloud.com/find.
Select the device from their Find My iPhone device list by clicking All Devices at the top of the screen.
Erase the device by clicking the Erase button. This will erase all content and settings from the device. When prompted, do not enter a phone number or message. Click Next until the device is erased.
When the erase is complete, click "Remove from Account" to remove the device from the account.
After the device has been erased and removed from the account, you can proceed with the device setup process.

You haven't told us exactly what kind of messages you are getting when you try to start the device. If you are asked to log into icloud with an ID and password, then if the previous owner had an icloud account defined and Find My iPhone turned on, then you won't be able to start it until you get the ID and password from the previous owner. There's nothing more you can do other then to return it.

Errors related to third-party security software
Error 2, 4 (or -4), 6, 1000, 9006
1. Follow the steps to troubleshoot security software. Often, uninstalling third-party security software will resolve these errors.
2. There may be third-party software that modifies your default packet size in Windows by inserting a TcpWindowSize entry into your registry. An incorrectly set default packet size can cause these errors. Contact the manufacturer of the software that installed the packet size modification for assistance or follow this article by Microsoft: How to reset Internet Protocol (TCP/IP).
3. Verify that access to ports 80 and 443 are allowed on your network.

Only its legitimate owner can remove an iPhone from Find My iPhone. If you did not purchase it directly from its legitimate owner you're out of luck.
