If your iPod is currently running iOS 4.2.1, that suggests that it is in fact a 2nd generation Touch, not 4th. If I recall correctly, the 4th gen Touch came with iOS 5 on it.
To check whether your iPod is 2nd gen, look on the back at the etched text (you may need a magnifying glass). If it states Model No. A1288, then it's a second generation Touch, which cannot be updated beyond iOS 4.2.1
Alternatively, if you connect your Touch to your iTunes Library (on your computer) and use the Check for Updates feature on the Device/Summary pane. If it comes back and states "your iPod is up to date", then there are no updates for it.

Backing up saves your settings and other stuff on core apps but it doesnt save your appdata(that's is the main thing i am looking for) so it wont restore that when i restore it from the backup i create and this article too says it http://support.apple.com/kb/HT4972 so i would like too know how do i keep my data stored in apps from the appstore if there is any way to keep the data.
