If you are referring to Activation Lock, the password for the Apple ID signed into the device is required, there is no way around this. If you do not have the information and cannot contact the previous owner, the device is useless.

Unfortunately, you cannot do very much with your phone unless you get assistance from the previous owner, they should either provide you with the password to unlock it or remove their account from the phone entirely remotely through iCloud.com > Find My Phone. -

File a complaint with eBay to get a refund on the useless iPhone.

I sold my iphone 4s and added some money to buy a second hand Iphone 5, i can't get into the phone because i need the previous owners apple Id and password and theres absolutely no way I can cintact the previous owner because i had thier number on my iphone 4s which was sold before i brought the 5.
Only the previous owner can unlock your phone, either by providing you with the code or by removing it from his liste of devices. I'm afraid that if you cannot contact him your phone is useless.

As has been pointed out, if there was a "previous owner", the phone is not "new". Thephone you purchased is most likely stolen. If whoever you bought it from won't give you your money back, turn it over to the police. -

Return it to the pawn shop and get your money back. The device is permanently locked and with the previous owner to unlock it you can never use it except as a paperweight.

If it has an activation lock set, you can't. Unless the previous owner removes it, the device is useless to you; Apple won't do this unless presented with the original receipt of purchase, and then only for the registered owner(unless they're dead).

Aloha! I bought an iPhone 5 sprint via ebay, it has an iCloud id that was used to previous user. I don't have any contact with the previous user. I want to delete that email or id account that is now existing in my cell phone.
Again, you wasted your money. You can ignore raymond73's post, as you won't be able to turn off Find My Phone or delete the iCloud account associated with this phone, without knowing that info.
I don't know how clearer I can be.
