Yes.
The only 'catch' you may encounter. Let's say your old one is running iOS 7.1.1, and your new one is running iOS 7.0.6, you will first need to update your new one to be running 7.1.1, then y ou can restore it from the backup of your old one and make it a near clone of the old one.
Chances are you won't encounter this, but there have been instances where folks get a broken ipad replaced and try to restore the new one from the backup of the old one and since the replacement is running an older iOS than the replaced one it doesn't work. In that case you set up the replacement long enough to update the iOS then restore it.
But, likely what will happen for you is what happened for me when I bought a new iPod Touch. I did a full backup of my old one then wiped it. Brought the new one home and during hte set up process I had a choice 'set up as new or restore from the backup of the old one'. I chose restore and my new one was a near clone of the old one. I still needed to set up wifi and enter a few passwords to websites, but the data and contents crossed over.

    You will be able to restore from the backup of the old iPad and then sync all of the other content but you may need to update a bunch of apps in order for them to work with iOS 5 - but yes - you can use that backup.

    Do not reset the old iPad until you transfer all purchase, backup and sync with iTunes one final time. After you have down all three you can then reset the iPad to factory settings.
    I would NOT reset the old iPad until you set up the new one just in case - but that is up to you. Before you reset the iPad ...
    Connect your iPad to the computer and launch iTunes. If you use auto sync just go ahead and let the iPad sync. Before you disconnect the iPad, right click on the iPad name on the left side under the devices heading and select Transfer Purchases. Let the process complete and then right click on the iPad name again and select Backup. Let the process complete and then sync one last time. Now all of your purchased content should be in iTunes on your computer and all of your data will be in the backup.
    When you set up the new iPad you can restore from the backup of the first iPad and resycn all of your content as well.

    I'm trying to transfer contacts, SMS from an iPhone 3GS to a 5s by restoring the 5s from a backup from the 3GS, but I keep getting a message saying the backup is corrupt or not compatible.
    I've tried upgrading the iOS on both to the latest version (6.1.6 for the 3GS and 7.1.1 for the 5s) before backing up the 3GS (to the Cloud) and restoring the 5S but I get the same error.
    I also tried Restoring iPhone for the 5s before another restore from back up, but I still get the same corrupt/incompatible error message.
    I'm using Windows XP and ITunes 11.2.2.3
    Any suggestions would be greatly appreciated!

    I just tried restoring the 5s from the cloud backup just using the phone (i.e. without connecting to iTunes) and it worked

    Go to Settings>iCloud>Storage & Backup>Manage Storage to confirm that the backup of your old phone is listed.  If so, go to Settings>General>Reset, tap Erase All Content and Settings, then go through the setup screens on the phone and when given the option, choose Restore from iCloud Backup and follow the prompts, choosing the backup of your old phone to restore to.  Be sure your phone is connected to wifi and your charger while it is restoring the backup.

    all long as the iphone software is the same or a later version then the backup file then you will be able to restore the phone from that backup... so in your case updating to 3.x (x= the next update) then you can restore from that 3.1 backup you have

    ‘iPad is disabled’ fix without resetting using iTunes
    Today I met my match with an iPad that had a passcode entered too many times, resulting in it displaying the message ‘iPad is disabled – Connect to iTunes’. This was a student iPad and since they use Notability for most of their work there was a chance that her files were not all backed up to the cloud. I really wanted to just re-activate the iPad instead of totally resetting it back to our default image.
    I reached out to my PLN on Twitter and had some help from a few people through retweets and a couple of clarification tweets. I love that so many are willing to help out so quickly. Through this I also learned that I look like Lt. Riker from Star Trek (thanks @FillineMachine).
    Through some trial and error (and a little sheer luck), I was able to reactivate the iPad without loosing any data. Note, this will only work on the computer it last synced with. Here’s how:
    1. Configurator is useless in reactivating a locked iPad. You will only be able to completely reformat the iPad using Configurator. If that’s ok with you, go for it – otherwise don’t waste your time trying to figure it out.
    2. Open iTunes with the iPad disconnected.
    3. Connect the iPad to the computer and wait for it to show up in the devices section in iTunes.
    4. Click on the iPad name when it appears and you will be given the option to restore a backup or setup as a new iPad (since it is locked).
    5. Click ‘Setup as new iPad’ and then click restore.
    6. The iPad will start backing up before it does the full restore and sync. CANCEL THE BACKUP IMMEDIATELY. You do this by clicking the small x in the status window in iTunes.
    7. When the backup cancels, it immediately starts syncing – cancel this as well using the same small x in the iTunes status window.
    8. The first stage in the restore process unlocks the iPad, you are basically just canceling out the restore process as soon as it reactivates the iPad.
    If done correctly, you will experience no data loss and the result will be a reactivated iPad. I have now tried this with about 5 iPads that were locked identically by students and each time it worked like a charm.

    Honestly, I don't think that they have any other way of accessing anything on the iPad than any other user has. The Apple Store genius will just put the device through the standard troubleshooting steps - in your case probably try to restore the device to factory settings and if that doesn't work, then they will make some sort of offer for a replacement assuming that your iPad is still under warranty.
    If I'm not mistaken they will probably erase the device in order to try to "fix" it. That's what restoring to factory settings does. I assumed that you were concerned about losing data - but if you are concerned that they are going to see something that you don't want them to see or access, I'm pretty sure that's not going to happen.

    1) you can get a replacement one, though you might have to pay the out of warranty price for the device (normal iPod touch 4th gen 8g = $99)
    2) If you don't have the iPod itself, its is highly unlikely they'll replace it since you won't be handing the original over (since its in your locker)
