You will need to restore your device as New to remove a Restrictions passcode. Go through the normal process to restore your device, but when you see the options to restore as New or from a backup, be sure to choose New.
You can restore from a backup if you have one from BEFORE you set the restrictions passcode.

I am having the SAME exact problem! Except instead of lock button broken it's my home button so I can't do the whole "put in recovery mode" deal. My screen only says "tap the home button 3 times" and it has my screen locked until I hit the home button but since it is broken I can't get in my phone at all. How to reset your Apple ID security questions.
Go to appleid.apple.com, click on the blue button that says 'Manage Your Apple ID'.
Log in with your Apple ID and password. (If you have forgotten your Apple ID password, go to iforgot.apple.com first to reset your password with a password recovery email)
Go to the Password & Security section on the left side, and click on the link underneath the security questions that says 'Forgot your answers? Send reset security info email to [email]'. This will generate an automated e-mail that will allow you to reset your security questions.
If that doesn't work, or there is no rescue email link available, then click on 'Temporary Support PIN' that is in the bottom left side, and generate a 4-digit PIN for the Apple Account Security Advisor you will be contacting later.

Downgrading to a previous version of iOS is not supported. If you have installed software to performunauthorized modifications to your iOS device, that software may have redirected connections to the update server (gs.apple.com) within the Hosts file. Edit out the "gs.apple.com" redirect from your hosts file, and then restart the computer for the host file changes to take affect. I need to change the security questions but there is no option in the "password and security" option to reset them .......what should i do ???

There is no way around activation lock, and no one can help you but the previous owner. If he can't remember his Apple ID ("user name"), he can try to find it as explained here: http://support.apple.com/kb/HT5625. After finding the ID, he can then reset the password if he doesn't remember it, as explained here: http://support.apple.com/kb/HT5787. If he is unable or unwilling to do this, you will not be able to activate and use the phone.

Music is not included with the backup for an iOS device, and erasing all content and settings on an iOS device has no effect on music in your iTunes library on your computer.
If music is missing from your iTunes library on your computer, restore if from your computer's backup.
If the missing music in your Tunes library on your computer was purchased from the iTunes Store, you can re-download the music without having to pay for it again.

You have to restore and thus erase the iPod. It is a security feature.
Disabled
Place the iOS device in Recovery Mode and then connect to your computer and restore via iTunes. The iPod will be erased.
