If it has an activation lock set, you can't. Unless the previous owner removes it, the device is useless to you; Apple won't do this unless presented with the original receipt of purchase, and then only for the registered owner(unless they're dead).

    Take it back where you got and and get your money back.
    As has been pointed out, if there was a "previous owner", the phone is not "new". Thephone you purchased is most likely stolen. If whoever you bought it from won't give you your money back, turn it over to the police.

    If you are referring to Activation Lock, the password for the Apple ID signed into the device is required, there is no way around this.  If you do not have the information and cannot contact the previous owner, the device is useless.

    Return it to the pawn shop and get your money back. The device is permanently locked and with the previous owner to unlock it you can never use it except as a paperweight.

    Only the previous owner can unlock your phone, either by providing you with the code or by removing it from his liste of devices. I'm afraid that if you cannot contact him your phone is useless.

    Unfortunately, you cannot do very much with your phone unless you get assistance from the previous owner, they should either provide you with the password to unlock it or remove their account from the phone entirely remotely through iCloud.com > Find My Phone. Take it back and get a refund.

    Login to the app store with YOUR ID. You can't use the app store without an Apple ID. If there are apps on the phone that were purchased with the original owners ID, you do NOT own them. The owner had no legal right to give them to you and they are permanently tied to the ID that was used to purchase them.

    I have absolutely NO IDEA what you mean by that. You can not "purchase an apple network id".

    I'm afraid so. The vendor should have restored it to factory condition before selling it, so basically he has sold you an unusable device. If you have no way of contacting him for a refund or to unlock it you are, as you say, stuck.
