You need to ask the previous owner to remove the activation lock. If you can't(and they don't do it on their own), the device is useless to you.

My new apple ID is signed in elsewhere on the phone.
I cannot sign out or delete the old apple ID account because I do not know the password.
I cannot reset the password because i do not know the email where the password is being sent.
I cannot reset the password via security questions because it is telling me the date of birth I am entering is incorrect.
I have no idea what to do now.
Please advise.

f you still have access to your old email address, go to https//appleid.apple.com, click Manage my Apple ID and sign in with your current iCloud ID. Tap edit next to the primary email account, tap Edit, change it back to your old email account and verify it. Then edit the name of the account to change it back to your old email address. You can now use your current password to turn off Find My iPhone on your device. Then go to Settings>iCloud, tap Delete Account and choose Delete from My iDevice when prompted (your iCloud data will still be in iCloud). Next, go back to https//appleid.apple.com and change your primary email address and iCloud ID name back to the way it was. You can now go to Settings>iCloud and sign in with your correct iCloud ID and password.
If you don't have access to your old email address, you will have to contact Apple to have them reset the password so you can disable Find My iPhone and sign into your iCloud account. You need to go to System Preferences (this may be called Settings in Mountain LIon)>iCloud and sign out. Then sign in with the new ID.

I have an iPad 2 with most recent update 8.1.3. I have been experiencing connection problems, wifi dropping all the time. I get the prompts to enter passwords for iCloud and i Tunes all the time. I finally synched my Apple ID with my iTunes ID but the iCloud is still connected to an old email. I cannot figure out how to delete it as iCloud is not accepting the password I am using. This may be related to a new feature embedded in iOS7 that shows all purchased music by default. Go to Settings > Music, then turn off Show All Music. See if the issue ceases once the feature has been disabled. This information is located on page 63 of the user guide below.

You have run into Activation Lock. Without the requested AppleID and password,
you will not be able to activate the iPhone. Return it for a refund if you can.

Are you running any of Symantec's (Norton) or McAfee's Internet security products or anything similar, or an antivirus/antispyware application? Some such utilities treat an upgrade to iTunes as a new application and can block the application from connecting. So you have to go in and reset the utility to allow iTunes.
The same thing can happen if you upgrade the security product (this has particularly been a problem with recent McAfee upgrades). Check the settings for your utility. If iTunes is still listed, remove and re-enable the exception for iTunes. Consult your utility's documentation for the appropriate procedure. If you have Norton, you can find instructions for that utility on Symantec's web page for iTunes. You may also need to check the built-in Windows firewall as well.
